Excellent chocolatepeanut! Did you have to get a solicitor involved and did you change banks?

CHOCOLATEPEANUT · 01/12/2006 23:56

No I did not change banks and I did not need a sol as I used free advice off site

nothercules · 02/12/2006 07:53

I went through the process and got back over 2000 pounds. I also opened another account just in case beforehand. Sadly though because we had some rather large unexpected expenses around the time we got our money back I was unable to pay off my overdraft with my bank so havent been able to close account.
They did tell us any more charges they'll shut our account down which I think wont look could on credit rating. I'm being very careful and will slowly start to pay off.

nothercules · 02/12/2006 07:53

No sol for me either. Just followed advice.

MossletoeAndWine · 02/12/2006 14:25

Hello all, just discovered this thread. Good luck with getting the charges back and chocolatepeanut that is heartening news.

Could do with just a little advice/straw poll actually, what's everyone think?

I'm in the middle of a battle with NatWest over charges myself.

It was dh's idea actually but eventually I came round to his way of thinking. I went on the consumer action group web site and got my statements; found out I could get £2,011 back!!!! This would pay off the last of my debts, and leave me a grand to spend on baby things - very, very handy!

After about three or four exchanges of letters, the bank are offering to pay me £1,200. This would pay off the debt, and leave me about £200 (still not to be sneezed at!!).

I've read lots of other people's stories on that web site, and it seems that if I push ahead with court action, I almost certainly would get the full amount. But it would be really stressful, take a couple of months and might leave me further out of pocket in the short term, with court costs and the like (although I'd get the costs back in the long term).

Dh thinks I should go for it but I don't know.

What d'ya think??

Boobooroastingonanopenfire · 02/12/2006 15:16

Hi MsMoss.

Obviously only you can decide, but watching my mother go through court trying to claim fees was quite distressing, and you're PG.

Do you think DH would take the lions' share of the responsibility to keep your stress levels down?

SpaceCadet · 02/12/2006 15:23

Hi all.
I started mt claim a few weeks back, so far I have had one letter telling me in no uncertain terme to bog off, basically they implied that i was a bad cistomer who had nt maintained my account well and also had the cheek to enclose a leaflet, telling me how to avoid going overdrawn in future!!!
I sent off, on weds a further more strongly worded letter(using the letter templates) and await with interest, I think theyt will call my bluff though and say bog off again so that I have to issue court papers..

hoolagirl · 02/12/2006 18:17

HI, I have lodged my court papers againsg Bank of Scotland/Halifax.
The most useful website I found was www.penatlycharges.co.uk which is very helpful with step by step advice for idiots like me!
I'll let you know how i get on.
My charges total £2,976 by the way!

MossletoeAndWine · 02/12/2006 18:21

Good luck everyone with it, Booboo thanks for advice, I told dh and he said that if I went through with it he would be prepared to take on most of the stress...

Seems like a gamble to me, but I'm not one of life's great risk takers so I would say that!

Having said that if it did actually end up in court, which I believe is highly unlikely, who are they gonna side with? A faceless corporation or a fat pregnant woman in a tent?

FLAMEinEckItsYuleAgain · 02/12/2006 18:39

Oi Spacey - been tryin to track you down!! Got no credit so not been able to text

SpaceCadet · 02/12/2006 18:41

hi flamesparrow

littlemisspiggy · 05/12/2006 16:28

Spacecadet, which bank was it?

Flumpybumpy · 06/12/2006 10:46

I was on the other thread, I sent off my letters to Barclays and requested back overpaid charges totalling £642.

I got a letter back saying although I had signed the T & C's when I opened the account they were happy to settle to matter and offered me £660 to go away!!

Needless to say I took it, although I can't work out why they gave me more than I had asked for, not complaining mind you!!

Christmas is looking better this year in the Flumpy household yipppeeee!!!!!!!!!

Flumpybumpy · 06/12/2006 10:49

BTW, I wouldn't have known about this if it wasn't for the original thread, so thank you to whoever posted that. Also, I didn't get as far as court proceedings, I just sent of the 1st letter template and got my statements, then sent the 2nd letter requesting the money!

Good luck everyone

Just been offered £2,170 from HBOS ! Result!

emjhill · 09/12/2006 20:24

Could someone please tell me what was on the original thread and how this works!?!?!?!?

jambuttie · 10/12/2006 11:04

I am interested too. get regular charges of £30 per month plus interest on top mostly for overdrawing our overdraft.

We are with Royal Bank of Scotland and not sure how I start all this rolling?

Do I pay a 1 of fee to get all the statements? or simply send a letter saying i want to claim all bank charges for over the past x amount of years?

A few months ago I got £125 in charges in 1 day-

jambuttie · 10/12/2006 13:49

Ok

I am about to send letter 1 to my bank wish me luck= PLEASE!!!!!

I am worried though that they will get nasty with me

MerryMellowmas · 10/12/2006 13:52

I spoke to my bank Halifax/Bank of Scotland last week. The woman I spoke with was a right Bi^&H.

When I told her I was considering taking them to court to claim back my charges, she told me I was most welcome to do so as the OFTED had ruled this only on credit card charges?

I will probably wait until after christmas now, although she pi$$ed me off so much, makes me want to do it more.

SpaceCadet · 10/12/2006 13:55

right well ove sent my 3rd letter, more satrongly worded telling them they had to respond within 7 days..nothing..so thats it, im sending court papers..its the lloydstsb for anyone interested.
