Driving without MOT

CM1897 · 08/09/2023 16:17

I don’t drive (health reasons), so I’m not sure how bad this is.

My ex has started to drive without an MOT, would you send your child with him in the car? Could he be arrested?

he’s due to pick our three year old daughter tonight, I’ve asked him to get a bus to pick her up, but he refuses. I’m not sure whether to keep her with me or not.

Thanks

Take the mot out of the equation

  1. do you believe your daughter is safe in his car being driven by him?
endofthelinefinally · 08/09/2023 16:18

I am pretty sure his insurance is not valid if he has no MOT.
Are you sure he has insurance?

kimchiforever · 08/09/2023 16:19

His insurance will 100% be invalid with an expired MOT

JamieJ93 · 08/09/2023 16:22

Not having a car with MOT could mean the car is unroadworthy (and probably isn't). If he can't be arsed to MOT his car, then he probably won't even have insurance. How could he even think about letting his child get in a potentially fucked car!!!

endofthelinefinally · 08/09/2023 16:24

Driving without insurance needs reporting to the police. My friend's son was killed by an uninsured driver. They tend to be careless, irresponsible people. A neighbour's husband was seriously disabled by an uninsured driver. No compensation due to no insurance.

RocketIceLollie · 08/09/2023 16:26

How do you know for sure he has no mot? Did he tell you so? If so, it seems odd that he would tell anyone he has no mot...

very easy to check any car at all as long as you have the reg. gov website checker

JaxiiTaxii · 08/09/2023 16:27

Firstly an MOT isn't that expensive, so if he's not got one I'd assume he's worried the car won't pass, which means the car isn't roadworthy.

Two, I don't get why on earth is he telling you this? If he's going to be an irresponsible twat, why is he letting you know that?

Are you supposed to sort it for him, or is he picking a fight?

BigFatLiar · 08/09/2023 16:27

If the police stop him they'll probably seize the car and he'll be fined and get penalty points.

Ah fair dues.

If he doesn't have an MOT then I would volunteer to drop child off to him instead so least the child is not missing out on Daddy time rather than just using it as an excuse to stop access.

CM1897 · 08/09/2023 16:31

So he missed quite a few finance payments on the car, so they took him to court and they are taking the car back in a couple of weeks. So he doesn’t want to pay for an MOT for a car he won’t have (that’s his reasoning).

I obviously only care about our daughter being safe.

He has quite a few points on his licence already so will lose his licence if he gets anymore, so I’m not sure why he’s risking that. If he shows up with the car this evening, I’ll keep her with me. It’s frustrating, because she’s excited to spend time with him

I don’t drive as I have epilepsy, but I’ll happily take her to him in a taxi or a bus. But he has her all weekend, so will drive with her without me knowing.

My car failed it’s MOT but the problem wasn’t absolutely urgent and I had to wait for the part to come in. I drove my car to drop kids off as it was absolutely heaving with rain and there were no other options other than dragging kids 30 mins in the rain. I took the chance, it was fine.

If he has no intention of getting a MOT and is causally driving around in a car which is not road worthy then that’s something I wouldn’t be comfortable with and probably wouldn’t send DC. I would however offer to drop them off just so it looked like I’d done everything right to facilitate contact if he tried to kick up a fuss about it

kimchiforever · 08/09/2023 16:33

Is he coming tonight?

kimchiforever · 08/09/2023 16:33

mot aside

how do you generally feel about his driving?

CM1897 · 08/09/2023 16:34

To be fair, he tells everyone everything. He’s definitely a talker lol. He tends to tell me the hood, the bad and the ugly about everything. Which I’m not sure is a good or bad thing

He’s an unsafe driver, he’s had court recently for speeding and jumping a red light. He has now done courses and I don’t believe he’d speed with our daughter in the car. He is responsible when it comes to her.

Not necessarily true actually! My car was hit by another car ( not my fault) after the MOT had expired ( i had the wrong month in my head for some reason and thought it was due in july but it was actually june!) the insurance company just took £50 off the payout when the car was written off because it didn't have a valid MOT!

MariePaperRoses · 08/09/2023 16:38

You tell him that you will call the police if he drives your daughter in a car that doesn't have an MOT and is not insured or the insurance invalidated.

The guy is a prick.

Is the car likely to be unroadworthy though? Does he usually drive unroadworthy cars? The existence or not of an MOT is irrelevant to the road worthiness of the car and his ability to drive safely. An MOT is not a proxy for safe.

(Insurance isn't invalidated by lack of MOT btw.)

M4rv1n · 08/09/2023 16:43

How can this even be open to debate?

Driving a car without MOT is illegal, it's that simple. No actual parent would ever allow their child to be driven in one.

comedownwithme · 08/09/2023 16:43

The lack of MOT specifically isn't what would bother me but his attitude towards safety is evident form that. He is one to cut corners, not pay unless he has to. This would bother me even if the car was MOTd tbh.

No it won’t. Depends on the insurer.
