My mortgage lender is refusing to allow a sale to proceed and obtained a eviction order .
I am submitting a N244 this morning, is there anything more I can do?

Why? That could not have just come out of the blue? What does your solicitor advise?

Lucyweeks · 07/07/2026 08:51

The court solicitor will accompany a hearing. That's it .

Is it because the sale won't pay them in full or something? There will be money still owed and they feel the house is being sold for less than it's worth?

Lucyweeks · 07/07/2026 08:54

Absolutely not. The sale more than covers the debt owed.

Weird as fuck then. You'd think they'd just be happy to be paid in full. I hope you get it sorted.

Lucyweeks · 07/07/2026 08:58

Thank you. It feels petty (I made a miss selling complaint). The legal advice has been to ask the court for a suspension

Op, is this not because the repossession order had already been served?

Lucyweeks · 07/07/2026 08:59

Yes it has

Where are you up to in your sale?

Lucyweeks · 07/07/2026 09:01

The court ordered the arrears to be paid in full or the house sold. It went sstc two weeks ago. It's at solicitors and they have to wait for a search

Yes it has

If you mean the repossession order has been issued, then it means you can no longer manage the sale yourself, they will do this. Thays standard.

Lucyweeks · 07/07/2026 09:08

They want us to leave the house. They haven't asked to manage the sale

If they have already obtained the repossession order which they must have to have applied for the eviction order then it is no longer your house to sell. They now have control.

chirrupybird · 07/07/2026 09:15

Have they been waiting a long time for you to sell to pay them back? Are there arrears on the mortgage payments? Or the final date is passed? There must be some reason.

Edit: OK arrears on the mortgage, yes they will take control and sell the house if you can't raise the money to pay them.

Ethelspagetti · 07/07/2026 09:26

Did you run out of time? Did you not communicate the sale? My sister faced similar and the bank took possession of the house before it could be sold. They basically took too long. They sold it and gave her the money minus what they owed and fees.

You haven’t sold your house then. You accepted an offer. A large proportion of offers accepted never actually proceed to completion.

Lucyweeks · 07/07/2026 09:31

Eight months since going on the market. £100k price reduction in that time. Final reduction resulted in the sale. BTL. Landlord

They don’t ask that, it is effectively theirs.

Lucyweeks · 07/07/2026 09:34

This is the only offer on the house this year. Last year the offer fell through.

So, who is in the property now?

And how far back do the arrears go?

It doesn’t matter op, I’m sorry it is no longer yours to sell.

I have 25%equity in the house

Who have you spoken to for help so far?

And when it initially went to court for the possession hearing did you have any help?

I'm so confused

Your family are in a property that you're describing as buy to let?

And the mortgage is up-to-date because you paid all of this year?
