Autistic son interviewed without appropriate adult

Hi my son who is 19 and autistic was not provided with an appropriate adult during the interview when he was arrested for breach of a restraining order which he confessed to in the interview.

He declined a solicitor at the police station so he had no support from anyone at the station during the custodial process and interview.

He was seen by a nurse shortly before the interview and then she gave the green light for him to be interviewed.

He is currently RUI and I was wondering what are the chances the confession could be excluded under S78 of PACE since this is a clear breach of PACE?

Autism isn't an excuse. If you are planning to excuse your son's criminal behaviour op, you'd better prepare for the next incident.

Just to be clear as I mentioned in my previous posts my son has always denied breaching the restraining order and made a false confession at the Police station in the hope he would get his computer back right away.

The Police either found no or not enough evidence during the forensic analysis on his computer that he breached the restraining order which is why the outcome has ended like this.

I would say my son is the real victim in all of this because the Police did not provide him with an appropriate adult when the law states they should have and therefor breached PACE (Police and Criminal Evidence Act) which led to the interview being unreliable evidence and likely bringing this matter to an end.

It also doesn't mean my son is guilty even though many people in this thread are talking like he is and that they feel "sorry" for the victim.

If my son tells me he did not breach the restraining order and also had forensic experts examining his computer then I 100% believe him when he says he has done nothing wrong.

Astounding... He's had his laptop seized twice for forensic examination and has a restraining order in place against him.
But it's all someone else's fault and your son is a poor maligned victim.

He'll do it again 🤷🏻‍♀️

Why wouldn't he, when Mummy assures him that he's the victim?

Your son doesn't get all of his actions justified just because he has autism. And just because he denies something. Autism isn't a get out of jail free card. Your son shouldn't have access to the internet at all tbh.

There is no evidence to suggest my son has continued his past behaviour which is why the CPS has discontinued proceedings even after computer forensic experts examined his devices.

My son is autistic, mentally vulnerable, and yet was not provided with the necessary safeguards at the Police station.

That is why I class my son the victim in this because the Police thought they could take advantage of my son.

So, it's okay for your son to take advantage of others to the point a restraining order gets put in place, "because he's autistic"

But the police 'took advantage' because they didn't get him the solicitor that he declined. Righteo.
Your son is no victim. Get him off of the internet.

There is zero evidence to suggest he breached the restraining order.

As I have stated multiple times already he made a false confession in the hope he would get his computer back right after the interview so that it doesn't have to be sent off for forensic analysis which can take a long time.

Completely agree. The victim is the person who had to get a restraining order against him.

I have two autistic adult children and I could very much see this type of misunderstanding. They would be factually correct right up to the bare wire of what was acceptable.

Exactly, the law cannot be ignored. And the OPs son has already broken that and been convicted.

I stand by what I said, if the internet is causing this much damage (to your son, crushing dreams) and in the OPs case, her son getting convictions, I think the internet should be taken away in both cases. To protect your son in his case, and the victim in the OPs case.

How do you propose taking the internet away from someone?
