Unauthorised photography within my home and sharing of the photographs

I found out that a contractor has taken photographs of the inside of my home that I did not authorise, one of them has got my child in the corner I’m fucking furious about. Obviously it’s gone from one employees phone to another and then it’s been forwarded onto who is thinks is me but actually I’m using an email address that isn’t the one that he would have on my contract if that makes sense so I think he’s on thin ice with that.

This can’t be legal surely ?

This is only an issue if the pic is published somewhere, on social or whatever. If it it stays within the sphere of the contractors work then not a problem.

Presumably the photos were taken to show you why they couldn't do the job

The photo was contemporaneous proof of the state of the room

It was sent (communicated) to you to show you what the problem was

Your kid happened to be in the photo

The contractor who took the photo sent it to his boss who sent it to you

You are absolutely overreacting

But isn't it your fault they were compelled to take the photo, because they didn't have proper access to do the work you'd contracted them to do? If they hadn't taken it as proof, you could easily dispute their word.

Plus where were you when your two-year-old was milling around them unsupervised while they snapped away? Surely unwarranted physical contact is far more worrying than a photograph?

Luckily I have text messages that confirm the other position/aspect of the dispute is incorrect. Fuck me for them to turn around and say here’s a photograph of your house that we took without your permission. I’m sorry I’m absolutely furious how dare they and if that is the legal position it makes me think twice about who will be coming in through the front door.

They did it to prove why they couldn't do the work from their perspective. And yes that's the legal position.

If you were able to give more details you could get more specific advice.

I think you are angry that they said they can't do the work so are channeling your anger into the photo instead of being angry at yourself for not doing whatever it was that would have allowed them to do the work.

It depends on why you've asked them into your home and what they are filming and the purpose of the filming.

it would help if you could clarify if you are in social/council/rented housing as opposed to private ownership ....tenancy agreements may come into play if it's the former situation , if you are being obstructive to essential/planned maintenance.

It's perfectly normal for contractors to take photos to show why they couldn't do the job.

You could ask them to delete the photo with your child in, but they are not breaking any law by taking the photo itself.

That’s right because they were in the wrong however it’s irrelevant I don’t care whether they were in the wrong they aren’t obviously going to be invited back so as far as I’m concerned they tore up the contract for them to have the audacity to photograph I’m sorry I think it’s disgusting.

How can people answer you properly if you won't say what happened.

That's not going to hold up in court for a single second if they decide to pursue a claim for breach of contract. They were gathering corroborating evidence and it will be seen as such.

I showed them what needed doing they looked at it. I moved towards the back of the house expecting that they were following me apparently they weren’t. They must’ve taken the pictures when my back was turned. I’ve literally got to the back of the house turned around to find no contract are behind me and then them outside on the phone presumably to the boss. He’s then tried to phone me which I found out later because the call didn’t connect it’s gone straight to voicemail and then the contactor is left obviously not a word about taking a photograph.
