Unauthorised photography within my home and sharing of the photographs

I found out that a contractor has taken photographs of the inside of my home that I did not authorise, one of them has got my child in the corner I’m fucking furious about. Obviously it’s gone from one employees phone to another and then it’s been forwarded onto who is thinks is me but actually I’m using an email address that isn’t the one that he would have on my contract if that makes sense so I think he’s on thin ice with that.

This can’t be legal surely ?

This thread would have been SO MUCH simpler had the OP actually told the story along the lines of ... I arranged for someone to come and fit a carpet and paid £500 in advance, the workmen turned up and said they couldn't do it because there was a table and an armchair in the way! They then took a photo etc etc etc

But instead she's fudged and given half a story and gone off at tangents and isn't coming across well at all.

Sorry OP but tradesman sometimes need to take photographs for evidence. My husband goes into houses day in, day out and unfortunately a few times CF claim he damaged x and try to put in an insurance claim. Luckily he has almost a sixth sense and knows when to take pictures of x and y. Recently one CF tried to claim and imagine her surprise when he replied with a pic of said damaged item.

Did similar happen OP and the only leg you have to stand on is that your kid was in a pic?

Unless your child is naked, i doubt theres much theyd do with the photo even if they were sick minded.

I wouldnt get gung up about it, but you could send them a stern Email to tell them why it has enraged you. they probably didn't even think it would be an issue

Your house must be very open plan for the photo to be of the lounge, hallway and back of the house.

Maybe they came to fit new doors and then realised her home was just one open square with no walls.

I think a contractor could easily argue in court that taking photos as evidence is a standard part of their working process. You invited the contractor in to work and a camera is one of the tools in the toolbox.

about to start tearing out a countertop and a nearby wall already has a tiny crack? Photograph before starting.

it’s no different than how renters are told to take extensive photographs of any damage to a flat when they take possession so that years later the landlord can’t try to charge them for damages.

Have to agree with everyone else (except on poster, I think).

It is not unreasonable at all for a contractor to take photographic evidence of why they are not able to do the work. Even more so if they detected that the customer was liable to kick off in such an OTT way.

Totally, a picture is worth a 1000 words and all that. We had someone round to quote for a new front door recently, they did all the measurements and took lots of photos too, inside and out.

And had the unspecified tradesmen in this situation NOT have taken a photo and refused to do the work, then you're into them saying the room isn't clear, you saying it is, then round and round in circles.

Quite, I’m trying to narrow it down by coming up with scenarios for OP to shoot down. If she wants actual advice it would be sensible to just post what happened!

Yes it absolutely does. By taking those photographs they have now become data handlers and I believe need to be registered with the ICO and handle my data accordingly. I guess the grey area is the fact that they were invited into the house and that’s what I was hoping to seek clarification on.

If your child's face is not visible and the photos are not being used for commercial gain, the contractor was not breaking any rules. You need permission if a) faces are visible and) the images will be used for commercial or editorial purposes.

They should have asked out of professional courtesy but as you are disputing the job and allowed them access, presumably pre agreed and with knowledge of the purpose of the visit, they have not done anything wrong, no matter how annoyed you are.

I haven't worked out if the contractors couldn't do the job for some, as yet, unspecified reason and took a photo to show why or they couldn't do the job because the child was there and took a photo to prove it!
