Who is "they"? Judges? Barristers? Criminal? Legal Aid?

Far too little information.

Parky04 · 15/09/2022 16:14

What kind of case is it? Only criminal barristers are on strike.

Criminal barristers are mostly self-employed. They are striking because the government has set the level of legal aid in criminal cases such that many are effectively working for less than minimum wage. The government has also closed over half the magistrates courts since 2010 and cut the number of staff, leading to large backlogs. These are the issues barristers want to see addressed.

Dreadful situation

So what may happen to the cases recently that could not go ahead??

Set for next year instead?

In what way?

So say strikes end in sept
Oct cases now get moved?
Or they go ahead as planned ?

The Criminal Bar Association, which is a body representing criminal barristers, is still negotiating with the Government. Most barristers are still not undertaking defence legal aid work. Courts are making decisions week by week as to whether trials are going ahead or not. In some cases they can go ahead because the defendant is represented by someone who is not on strike for one reason or another. In most cases trials are being postponed. Trials where the defendant is on bail are for the most part being postponed to next year. Trials where the defendant is in custody are being postponed to later this year. The police witness care unit should keep you up to date - if you have contact details for them or for a police officer dealing with the case give them a ring and ask what's happening.

This is so helpful thank you

It has been very hard to get some add info on this

So we really just wait and see

Hope the negotiations work out ok!!!!

Anyone else in my shoes?

There should be some news early next week. The Government have made an offer which we (barristers) are going to be told about later today and there will be a ballot on whether to accept the offer. I expect the result will be published on Monday or Tuesday next week. I'll keep you updated.

Queenie6655 · 29/09/2022 09:52

Thank you so so much

So say for example a case coming up in 2 weeks

Could it go ahead ?

Or will it be knocked back due to sept cases not been heard?
