Family Court and vaccinations

Hi, all.

Has anyone been to family court over a disagreement over whether or not to vaccinate a child with no health issues?

Please would you tell me if the judge ruled in favour of or against vaccination?

I can’t imagine them ruling not in favour. They will weigh up what is in the child’s best interest and unless there is a medical reason they can’t be vaccinated it will be in the child’s interest to be protected from life threatening illness.

Even if for arguments sake it did cause autism (which it doesn’t) it would still protect them from dying of something like measles. I know I would chose to have my two autistic children alive with autism than die of a preventable disease.

Sorry, I didn’t want to cause a debate as it makes my heart all palpitatey. FTR, I am pro, ex became anti upon starting his subsequent relationship.

Before I knew that he had become so, I stupidly allowed a “no medical/therapeutic treatment without both parents’ consent” clause in our CAO. I did this because his wife is an alternative medicine therapist and was repeatedly telling our 9yo that there were things wrong with him that she could fix and messing around with his neck at home, sometimes even after a few drinks. Her regulatory body doesn’t care.

Flumist isn’t the hill I want to die on (thankfully snuck in youngest’s preschool jabs beforehand) but HPV feels important and if there are travel restrictions without a covid vaccine then I want to be prepared.

Thanks for your reassurances - I’ll take a look at those links too. Everything I was searching ended up being about kids in care when both parents were anti.

If it is HPV vaccine at high school they will let the children consent for themselves. Same with flu jab.

My family work with children in care, and have had two recent family court cases where judges agreed to vaccinate children whose parents were antivaxxers. There's definitely precident.

If your ex has PR he is entitled to a say in your child's medical treatment regardless of whether the CAO says so. However, I agree with others. There is no way he will win on this. If it ended up in court they would definitely rule in favour of vaccination.
