New drive

Hi was wondering if anyone could help... I had a new drive laid yesterday which isn't the colour of resin I chose. They provided me with a sample and I agreed that was what I wanted however it's completely different.

They agree it's not what I chose and that the sample is different but because it has the same name as the sample they gave me they think there isnt a problem.

They offered to take £500 off the price or re do it.... I asked for it to be redone and they then got nasty and said I was the most awkward customer ever and I'll be hearing from their solicitor.

I haven't paid anything yet... any advice welcome.

Stressed, the police can't help and I feel I was slightly mislead by consumer rights. The police officer was sympathetic but told me to get a solicitor! Either let them relay it, take their surface away or get a solicitor...so it seems thugs like them have the upper hand, quite depressing really. Thank you for thinking about me though x

The police should be able to deal with the threats, they seem very clear. The threats are separate from the dispute about the drive.

Hello everyone, thank you for your concern. No, they emailed me on Friday saying they had marked the drive to be taken up and would be in touch. They don't care now as obvs I'm not going to pay for a marked drive whereas before it was about threats to make me pay.

Whether they will be back I don't know, it will cost them more to remove it than to leave it. So I feel in limbo...I don't want to get in touch to ask about it as I really can't take any more.

If they don't I feel like I'll be waiting for ever to reclaim 'their property', if they do, god knows what mess they will make... I feel I can't win

the best thing about this is that you haven't paid ... so they will be desperately trying to work out ways of getting that payment... the ball is in your court OP... this is why they reacted so aggressively... hopefully your Cameras will be fitted soon too to help with at least having footage of them coming round... I know its not complete comfort but it is extra security ... I hope you your and your daughter are okay too 🌺

BlueThistles. Yes, you're right. I think that they must have given up with the hope of getting money now which is why they spray painted it.

Can you get a quote for uplift and a separate one for re laying from another firm?
If they do take it up then you can pay new firm, if new firm have to uplift you can then take first company to small claims for the costs.

I have been in a similar situation but fortunately the work was behind a locked gate which they admitted in court trying to access.

I agree there are 2 issues. 1 civil 1 criminal. To rectify the civil file a small claims court request for the cost of removing and relaying as per the contract. Get 3 local businesses who you would consider for the work to cost the job for you and submit your claim for the average of the 3/cheapest depending on differences in prices.

Then the criminal case ask to make an appointment with an officer and show them the threats on your phone and criminal damage to your property. The text messages you can prove beyond reasonable doubt. The criminal damage is circumstantial and the business will obviously try and claim they marked it up for removal so you may need to drop that side of things.
