Rapist may be out in as little as 4 years

'A 16-year-old schoolboy who raped a teacher has been given a life sentence at the Old Bailey.

The judge told the youth that he had violated the teacher's classroom - her place of safety - and had left her "physically and mentally scarred".

He said he agreed with a doctor who said his behaviour suggested that he had planned or rehearsed the rape in a fantasy.

The youth, who had pleaded guilty to rape at an earlier hearing, will be eligible for parole after serving four-and-a-half years.

But he will not be released until doctors consider he is no longer a danger.

The teenager, from south London, was 15 when he attacked the 28-year-old teacher on her second day at a central London school in September last year.

Brendan Kelly, prosecuting, said the teacher was in her classroom when she was grabbed round her neck and pulled to the back of the room.

The court was told that the 5ft 11in, powerfully-built teenager head-butted and threatened to kill the woman as she fought him off.

But she was overpowered by the pupil and sexually assaulted. After the attack, the teacher ran naked to the headteacher's office.

Describing the impact of the assault on the victim, Mr Kelly said: "The effect of this attack upon her has been devastating.

"Since the incident she has been unable to teach. She anticipates that once 'all this' has been put to bed she proposes to go back on a trial period - not to the school in question, she will go to another school.

"Her confidence has been devastated, her social life equally has been devastated. She lives in fear of returning to her vocation."

Judge Moss lifted a court order protecting the youth's identity but stayed this until Friday afternoon after the defence said it wanted the decision reviewed by the High Court.

He ordered that Westminster City Boys School, central London, where the teacher was attacked after working only two days in September last year, could be identified.

After the case, the teacher said: "I was very glad to be alive because I did not think I would be.

"I honestly thought that I was going to be murdered, on top of everything else."

She said she is now trying to rebuild her life. '

Make you feel all nice and safe, doesn't it?

he could be out in as little as four years. It makes me feel sick.

HH- how do you know you can't rehabilitate a rapist? Is it just a gut reaction? And do you seriously think you should shoot people as a means of justice? If you truly believe that then I thnk you should be obliged to also have a watertight response the relatives' questions when it was proved that their executed son/father/husband had been framed, was in fact innocent, or was mentally impaired.

Who was the guy who was released after 27 years in prison for a rape and murder he did not commit, but was too 'simple' at the time to defend himself adequately? Do you think executing him would ahve been 'justice'?

Sorry but the death penalty makes my blood boil. I can understand how people are attracted to it - and lets face it if someone attacked or killed my kids I would want to kill them, no question, but I would expect the state and society to stop me from doing it.

fairyfly · 04/07/2005 22:12

i also believe for a woman to ever get over something like this she has to let go of her anger and heaven forbid learn to forgive. Revenge is soul destroying and would and does ruin lives. It is of no benefit for healing and building a new life. As for safety and protecting our society we have to understand that people commit crimes for entirely different reasons, you cannot treat all rapists the same, we have to try and work out cases individually.

I certainly don't want to live in a society where people are branded. Sending every single person into a state of hysteria and high panic. How revolting for our children to live like that.

wordsmith · 04/07/2005 22:31

I think the victim has actually commented that she'd like to think her attacker would be receiving treatment in jail, as if this were not the case he would probably be able to put other women through an even worse time than she had had.

HappyHuggy · 04/07/2005 22:34

i do think you cant rehibilitate a rapist. theres something in them thats evil and needs to be distroyed.

and i do believe in the death penalty

Im bowing out of this arguement for now, but will be back later.

Love and Light to all xxx

HappyHuggy · 04/07/2005 22:34

should have said

i dont....

tillykins · 04/07/2005 22:35

I have no idea if you can rehabilitate a rapist. But I am not prepared to take the chance

joash · 04/07/2005 22:44

why bother with castration - peel his dick with a blunt knife, rub salt into it then throw him to his 'victim's friends and family. (Not vindictive at all).

joash · 04/07/2005 23:01

Talk about killing a thread!!!!

HappyHuggy · 04/07/2005 23:02

i dont know whether you were being serious or sarcastic joash. but i think thats a good idea sll the same.

joash · 04/07/2005 23:02

Definately serious.

fairyfly · 04/07/2005 23:07

How is it a good idea?

Who's going to do the salt rubbing and skin peeling back?

what on earth would the " victims" friends and family do with him?

HappyHuggy · 04/07/2005 23:10

i'll do the peeling back and salting.

joash · 04/07/2005 23:12

You're not telling me that theres no-one out there that wouldn't do the salting!!! And I know what my friends and family would do to him, had it been moi!!!

fairyfly · 04/07/2005 23:20

i don't know anyone that would want to do the salting, nope, cant say i do

joash · 04/07/2005 23:21

Perhaps we should develop some sort of block and tackle contraption that would just lower him into a vat of salt.

HappyHuggy · 05/07/2005 00:27

sounds good to me joash

ScummyMummy · 05/07/2005 06:05

Good grief. This kid was 15 when he committed this horrific crime and has been given a life sentence for what he's done. (Rightly). He's clearly severely mentally ill and probably has a history of terrible trauma and abuse, as fishfinger says. Of course it's a disgrace that he was wandering around a mainstream school and able to perpetrate such a terrifying ordeal on this woman- it sounds like the police didn't cover themselves in glory by failing to alert social services/ the school of his suspected involvement in the earlier crimes. Be that as it may, it's really horrible to read some of the suggestions on here.

HappyDaddy · 05/07/2005 12:28

To all those with the draconian ideas, what about those wrongly convicted?

A friend of the family is doing 7 years for the rape of a 15 yr old girl. This would be fine IF he was guilty but he isn't. She invented the whole thing to get back at him. Why? When she was much younger she stayed at a group home that he and his then wife ran. His wife ran it while he worked in an entirely different industry full time, they have two boys who lived with them, too. His wife died and he gave up his career to continue running the home. He met another woman who became his girlfriend and helped him run it. A couple of years ago, she was diagnosed with advanced cancer. He couldn't cope with running the home and looking after her so he had to close it. This young girl, who had a history of being difficult and a notorious liar was understandably upset so she went to the police and told them that he'd been raping her for years. He was arrested, charged and convicted purely on her word. Because of her age, he wasn't allowed to cross examine her and no-one took any notice of the fact that the dates she said he'd been raping her coincided with him being abroad on business on at least three of the accused occasions. In court the judge had to tell her and her friend, in the public gallery, to stop laughing and keep the noise down throughout the trial.

Now, he's on the sex offenders register for the rest of his life and his two boys are on the at-risk register. His girlfriend's cancer is now terminal and will probably be dead before he gets out of prison.

Now let's brand him a rapist, shall we?

We're also supposedly a civilised society, above lynchings and the like.

Huggy was venting her fury, something we all need to do from time to time and this thread appeared at the appropriate moment.

I find it incredibly hard to believe that a man was convicted of rape in those circumstances with no supporting forensic evidence, HappyDaddy. God knows cases with real evidence to nail rapists don't get to court often enough these days.
I agree with Scummy. This boy is clearly profoundly disturbed and dangerous. With his previous violent history he should never have been allowed to get to the point where he could assault a teacher. I am very glad the NUT is tackling the LEA on behalf of the woman he attacked. And the police have a lot to answer for too.
I read a brief interview with the woman he raped in the press this morning. She wants him treated and rehabilitated, and if not, kept in secure confinement until he is no longer a danger to other women. Sounds right to me.

HappyDaddy · 05/07/2005 12:48

I accept that it's good to get things off your chest on here, much healthier than in real life. That's kind of why I posted, too.

I have no idea why his evidence wasn't admissable but the judge allowed nothing to even question this girl's word, not even that her friends had made statements to say that she'd made it all up. All I know is that a good man is rotting in the nonces wing of prison and is a completely broken figure now. He was a career teacher so now will be unable to get a job when he is released.

HappyDaddy · 05/07/2005 12:53

Can I also apologise to all of you who have suffered this crime yourselves, please? My post is probably misplaced and I do understand your strong feelings.

piffle · 05/07/2005 12:58

Detention of minors is difficult though, as in the cases of the boys who killed Jamie Bulger.
The teenager concerned could have been given a longer detention and then released, this may or may not include lyschiatric help and rehabilition. At least there is some chance that if/when he is released that there will be no danger of him committing an offence like this again. I mean what does prison really do for criminals aside from making them better ones? We have to believe in education and rehabilitation, especially of young people. Obviously there are lines in the sand and some crimes should mean a lifetime of detention, end of....
And I say that as former rape victim.
