Rapist may be out in as little as 4 years

'A 16-year-old schoolboy who raped a teacher has been given a life sentence at the Old Bailey.

The judge told the youth that he had violated the teacher's classroom - her place of safety - and had left her "physically and mentally scarred".

He said he agreed with a doctor who said his behaviour suggested that he had planned or rehearsed the rape in a fantasy.

The youth, who had pleaded guilty to rape at an earlier hearing, will be eligible for parole after serving four-and-a-half years.

But he will not be released until doctors consider he is no longer a danger.

The teenager, from south London, was 15 when he attacked the 28-year-old teacher on her second day at a central London school in September last year.

Brendan Kelly, prosecuting, said the teacher was in her classroom when she was grabbed round her neck and pulled to the back of the room.

The court was told that the 5ft 11in, powerfully-built teenager head-butted and threatened to kill the woman as she fought him off.

But she was overpowered by the pupil and sexually assaulted. After the attack, the teacher ran naked to the headteacher's office.

Describing the impact of the assault on the victim, Mr Kelly said: "The effect of this attack upon her has been devastating.

"Since the incident she has been unable to teach. She anticipates that once 'all this' has been put to bed she proposes to go back on a trial period - not to the school in question, she will go to another school.

"Her confidence has been devastated, her social life equally has been devastated. She lives in fear of returning to her vocation."

Judge Moss lifted a court order protecting the youth's identity but stayed this until Friday afternoon after the defence said it wanted the decision reviewed by the High Court.

He ordered that Westminster City Boys School, central London, where the teacher was attacked after working only two days in September last year, could be identified.

After the case, the teacher said: "I was very glad to be alive because I did not think I would be.

"I honestly thought that I was going to be murdered, on top of everything else."

She said she is now trying to rebuild her life. '

Make you feel all nice and safe, doesn't it?

he could be out in as little as four years. It makes me feel sick.

Exactly fishy one. This particular case sounds horrendous for the teacher but it doesn't sound as though the kid's life has been a bowl of cherries either. But I don't know, I'm not privy to the reports, like everyone else demanding his balls in a sling obviously is.

My DH bought the Sun the other day. he said he wanted to read something in the 5 mins he had before meetings. And he managed it.

I will be interested to see what the broadsheets say about this tomorrow. Even on R5 there were lots of hints from the police spokesman that there was more to it than meets the eye. And it sounds to me that by imposing life imprisonment, whetever it means in the end, they are taking it pretty seriously. I can't think of many other cases in the news recently where such a sentence has been imposed on someone so young.

HappyHuggy · 04/07/2005 21:45

(dont get the refernece to the sun)

i wasnt talking about the 15 year old in particular.

but do still think that my ideas for punishment were what i would like to happen (again not specifically talking about the 15 year old)

whats wrong with branding a rapist a rapist, putting a big perminate sign on his forehead? safer for women.

happymerryberries · 04/07/2005 21:46

while i feel sorry for the boy [who obviously has serious mental health problems] my personal concern is that someone a dangerous as he was in mainstream, a disaster waiting to happen. for all i know i could be walkingninto a classroom tomorrow where there is another timebomb, for me or another child in the class. this is awful for all concerned .

HappyHuggy · 04/07/2005 21:49

i wouldnt worry about it - i think it was me being refered to as unhinged

and im not denying that i am......

wordsmith · 04/07/2005 21:49

HMB, yes teachers do need protection, but in a school you are likely to be a damn sight safer than walking down the street, in a dark alley or (let us not forget) in your own home with your own loved one where, and by whom, the overwhelming majority of serious sexual assaults occur and are perpetrated.

fishfinger · 04/07/2005 21:49

or in the home actually wordy too arent htey

wordsmith · 04/07/2005 21:53

That's what i said !

BTW I do not mean by any of this rationalising to imply that rape is not a completely serious crime and that the perpetrators, when found guilty, should be punished. However in many cases (and this one in particular it seems) more could be achieved by combining incarceration with treatment. Detaching him from his balls would not necessarily do the trick, and I dont think his victim has expressed that desire at all.

HappyHuggy · 04/07/2005 21:53

i dont think that you can rehibiltate a rapist.

happymerryberries · 04/07/2005 21:54

true, but 6the nature of the job often places you in 1 to 1 situations with children, ina way that few other jobs do. i try to act prudently, but it can be difficult toalways be in ear shot/ sight of others. we are also in a place of trust which can be misconstrued by some people. wheras we do not need to know the detail
i do feel that we should be given a realistic safely evaluation of students we are expexted to work with.

OP posts:
HappyHuggy · 04/07/2005 21:54

and why should public money be spent dping so? its far cheaper just to shoot them.

happymerryberries · 04/07/2005 21:56

because sometimes you wouldshoot the wrong people.

OP posts:
fairyfly · 04/07/2005 21:57

what on earth would shooting them do, it would be after a rape, so the woman would not only be suffering from that but also have to deal with the pychological damage a killing would bring

fishfinger · 04/07/2005 21:58

ff htank GOD

fairyfly · 04/07/2005 22:00

i hope the tattoo on the head was a joke, i really do

HappyHuggy · 04/07/2005 22:01

i didnt suggest the tattoo on the head but i cant see the problem with it either. why not lable a rapist a rapist?

tillykins · 04/07/2005 22:02

I think I'm the one referred to as unhinged for suggesting branding
But whilst I don't normally get into the contentious issues and don't pretend to be an expert in this field, I will say this

I don't care if I sound unhinged or if I should have more experience in a court room or if you think I am making silly statements. What I do care about is that the victim of a rape, and other potential victims are given priority over the man that raped. I don't care if the sentence is harsh, I only care that he is prevented from raping again. My heart won't bleed for a rapist

HappyHuggy · 04/07/2005 22:05

agree tilly
