I don't think there's any duty on a solicitor not to take a case just because it's ridiculous. S/he gets paid, after all.

Waste of court time though at least he had to pay costs.

Unbelievable!

My friend has decided to give up midwifery because of the fear of being sued.
Apparently the name of the attending midwife stays on the babies record for 20 yrs and they can be sued any time.

I am glad the Irish legal systemn has some common sense.
Would he have sued the hospital I wonder if the midwife couldn't clear the baby's airways due to him getting in the way and the child sufferered with problems as a result?
Of course he would!

I'm really surprised that his solicitors wanted to run it.

It is an Irish case so their regulations are different, but in England and Wales you'd be obliged to pretty strongly advise your client not to continue with this stupid case. I would imagine his solicitors would have done this, though, some people are just too pig headed to take advice.
