The appeal after the overturned convictions. I hope this can all be brought to a close now.

I agree Floraclara. There is a simple narrative that makes absolute sense.

RG broke in order to burgle the place, he was disturbed by Meredith, he assaulted and killed her, left his DNA everywhere, left bloody hand and footprints, stole her mobile phone and disposed of it in a nearby garden, ran to a friend's house and then a nightclub to create an alibi.

After a couple of days he fled to Germany and was then arrested. Once he realised that the police were interested in RS and AK, he come up with a story that implicated them. He could not dispute the DNA evidence, so he confessed, got a fast track trial and reduced sentence.

RS and AK then found themselves in the weird world of prosecutor Mignini (see the Monster of Florence case for background on him) who dreamt up the sex game scenario with no evidence to support it.

Cross post Portofino. But we seem to have reached similar conclusions.

Floraclare · 02/02/2014 22:39

And before the sex game scenario there was the satanic rite - and now we have the even more bizarre motive of an argument over a poo. It should all have been so simple to solve - and the Kercher family would not have been put through the 6-years of hell and confusion that these bizarre trials and media obsession with Amanda, must have caused

This account by Douglas Preston gives a terrifying portrait of the original prosecutor, Mignini. Preston started investigating the Monster of FLorence murders and had to leave Italy when threatened by Mignini.

Mignini managed to actually jail Preston's colleague Spezi - illegally at some point (6 days without seeing a lawyer or something)

PortofinoRevisited · 02/02/2014 22:55

It is terrifying really!

Yes - it is totally ridiculous how they moved from the sex game/satanic ritual to making this about cleaning, when they realised no one accepted the first scenario.

Did they even check whose poo it was?

Birdsighland · 02/02/2014 23:40

I've found a synopsis of the Florence trial.

themurderofmeredithkercher.com/Nencini_Appeal

I wonder if the full transcript will be translated into English so we could see verbatim what has been said.

They were most certainly instructed to look at all the evidence.

PortofinoRevisited · 02/02/2014 23:43

Yes - they did check the poo.

I'd say they did a thorough job in the Florence appeal as they really had to look at all the evidence this time.

"The prosecution was led by Alessandro Crini, supported by veteran Florentine prosecutor Tindari Baglione.[2] Prosecutor Crini opened by stating that this appeal is unusual, not because of the case but for the course followed. Usually appeals are narrow in focus, but this one is not, because the Supreme Court annulment of the previous appeal was total. Hellmann's court's reasoning did not just have a few errors, but was "razed to the ground" by the Supreme Court.[5]"

Birdsighland · 03/02/2014 00:12

Of course, it's very difficult to know who bumps into who. If AK + RS took drugs, did RG deal to them? Did I see him described as being involved with drugs somewhere?

Lioninthesun · 03/02/2014 00:21

Yes, he was their dealer IIRC.
This thread is quite farcical. It seems even when professionals have done their jobs and we can all see the evidence and transcripts, there will always still be a lot of people out there not willing to believe it.

I admire your spunk in trying to convince the conspiracy theorists though Birds Grin I think I will have to hide this thread now as it keeps bumping up my feed with conjecture...

Lioninthesun · 03/02/2014 00:23

Curious - did any of the believers offer an explanation as to why the crime scene was so clean? I.e not consistent with someone with a slashed throat and multiple stab wounds? Do they think RG cleared up after himself and forgot to do the bloody footprints and his palm print etc?

Birdsighland · 03/02/2014 00:28

I'm tired now. Going to bed. Smile

Floraclare · 03/02/2014 08:07

Lioninthesun - there were no signs of a clean, you would have expected to have seen swirls when the luminol was applied if blood had been cleaned up, but nothing was seen. The defence asked for this to be properly analysed but the prosecution refused and This court denied their requests, along with denying the other defence requests such as testing the semen stain found under Meredith's body and opening the knife as advised by the Independent experts - as if murder weapon blood would have seeped into the handle. It's usually the defence that want these kind if requests denied - but this case is all the wrong way round

The murder occurred in Meredith's room, which is why that was where all the blood was. It is likely Guede had some blood on his trousers and went to the bathroom to wash it off - took his shoe off, which caused the bloody footprint. Couldn't get out the cottage as the door was locked so went back to Meredith's room and found her keys - likely stepped in blood at this time, which caused his footprints from out of Meredith's towards the front door. Absolutely no evidence of a clean up - although I think a proper analysis would have been helpful

stickysausages · 03/02/2014 08:16

So who staged the break in?
Why did AK say she'd never met RG, he was their dealer?

TheOneWithTheNicestSmile · 03/02/2014 08:42

Nobody 'staged' the break-in - RG broke in

Where does 'he was their dealer' come from? Never heard that before

DrankSangriaInThePark · 03/02/2014 09:08

I haven't heard of him being their dealer tbh, though he was a dealer.

The report of the proceedings from the original trial detail the testimony from the boys who lived downstairs (who also knew RG) about his interest in AK prior to her starting a relationship with RS though. (Massei-Cristiani report)

I expect they are corrupt and lying as well though, what with them being Italian and all. Wink

ExcuseTypos · 03/02/2014 09:31

And now the judge who gave the verdict last week, seems to be in trouble.

He seems to be saying that it is all AK's fault and her poor boyfriend is innocent. Surprise surpriseAngry

DrankSangriaInThePark · 03/02/2014 09:41

Yes, I commented on this on Saturday.

I don't see where he is implying anything of the sort about RS? The last paragraphs in particular detail how cross Bongiorno and co are about the judge's interview?

DrankSangriaInThePark · 03/02/2014 10:01

I have just read the entire interview given to the newspaper by the judge and he comes across as far more critical of RS. He says (loosely translated) that he did himself no favours during the trial by not agreeing to be cross-examined (Bongiorno laments that he was never asked if he wanted to be....from a lawyer of her standing that comes across as disingenuous and clutching at straws after the fact I'd say) but only giving "spontaneous declarations". (ie taking the stand and delivering carefully prepared speeches with no Qs and As of any kind admitted)
He also confirms that RS's lawyers asked that AK and RS be determined separately but that the judges decided this was not appropriate.
Looks v much to me like Bongiorno and the RS camp were running scared of this verdict from the start, and did everything they could to downplay any role he may have had and get him distanced from her as soon as.
The judge was also asked why RG wasn't called. He said there would have been no point. He has never admitted committing the crime.

AngelaDaviesHair · 03/02/2014 10:38

A coroner does the official autopsy

Coroners conduct inquests. They don't do autopsies (post mortems), though they have to have degrees in both law and medicine so they are qualified to assess forensic evidence.

Post mortem examinations are done by pathologists.

So, if the Italians use a similar terminology, surely it isn't right to say coroners do the official autopsies?

horsetowater · 03/02/2014 14:17

Floracare I also noticed that the imprint on the bath mat was half off and half on and you could see a heel imprint on the floor in the first video. Maybe I'm seeing things but it is hugely unlikely that he would have left that imprint on the floor and left the carpet in there if he had cleaned up.

What was the thing about AK buying bleach and cleaning products in the morning - did that actually happen?
