Rapists jailed for just 40 months after judge says 11-year-old victim was 'willing'

KRITIQ · 22/02/2012 14:46

story here.

"Judge David Farrell QC jailed them both for just 40 months each as he accepted the claim that she was willing and looked "at least" 14."

Funny, but I thought 14 was still under the age of consent for sex with a 21 year old man, quite apart from the fact that how a girl or woman "looks" should NEVER be a justification for rape, full stop.

I despair.

Good grief.Whatever next?It makes me wonder about some of these judges personal lives tbh, this one obviously has his boundaries completely confused which is why the bloody guidlines are there to be followed.

Bump

If she was so willing, how did it end up in his court?

VeryLittleGravitas · 03/03/2012 22:48

Sandelwood

Because children under the age of 12 can't give consent...it's our equivalent of statutory rape.

Sandalwood · 03/03/2012 23:07

I know.

Vanfurgstan · 03/03/2012 23:08

I think sandalwood was being sarcastic. Bumping again. Is there an update in this ?? Any progress?

NigellasGuest · 04/03/2012 10:16

bumpy bump with big fat bumps on it

Vanfurgstan · 04/03/2012 13:46

has any1 heard back from their MP?

PattiMayor · 04/03/2012 14:01

We have until Friday to write to the AG everyone:

"The Attorney General, who was flooded with complaints over the ?weak? sentencings handed by Judge Farrell QC, who also said the victim was a ?willing participant? to Channer and Monteiro last month, has until Friday to decide whether to refer that case to the Court of Appeal, which could replace the jail terms."

Vanfurgstan · 04/03/2012 14:02

how do you write to the AG?

PattiMayor · 04/03/2012 14:15

SardineQueen posted this further down the thread :)

And also tell us which case you are concerned about and why you think it should be changed. You should contact the Correspondence Unit. The Attorney General's Office will email you when a decision is made whether to refer the case to the Court of Appeal.
Don't worry if you don't have all the information, but the more you can give us, the more likely it is that we will find the right case.
If you can, also phone the Attorney General's Office on 020 7271 2492. You may need to leave a message."

Any judge coming out with these kind of judgements, and there have been many over the years, has got to have sympathies with the offenders. Everyone with normal morals finds it abhorrant! AngryI would be looking very closely at their personal lives if I were the local constabulary! Hmm

Vanfurgstan · 04/03/2012 17:20

Thanks patti. I will email him too. Can't get this story out of my head.

Vanfurgstan · 04/03/2012 20:04

Come on everyone we need to raise our voice and write to the relevant people. That's the only way we can change this disgusting attitude towards children.

VeryLittleGravitas · 04/03/2012 20:19

Sorry Sandalwood, my sarcasm detector is on the blink again.....bumps thread

Sorry VeryLittleGravitas, I should do the little 'hmm' smiley.

timtam23 · 05/03/2012 14:57

I posted a couple of days ago after my MP replied very promptly to my email about this case - MP continues to be impressively speedy here, as I got a letter from him today saying he's written to the Secretary of State for Justice (Ken Clarke) and as soon as he gets any reply he'll let me know.

Well done to my MP - anyone else getting any replies?

Vanfurgstan · 05/03/2012 21:56

That's great news timtam. I wrote to the AG but dont knw who
my MP is. Also I dnt write very well. Can u send me a draft I can send to the MP. I am disappointed this thread hasn't received than many hits and needs to be bumped so often.

SweetTheSting · 06/03/2012 14:09

Emailled AG!

SweetTheSting · 06/03/2012 14:50

Got v quick response from AG's office:

Thank you for your email concerning the sentences given to both Roshane Channer & Ruben Monteiro.

We are aware of this case and have already asked the Crown Prosecution Service (CPS) for more information about the case so that the Law Officers can look at the sentence passed to see whether it should be referred to the Court of Appeal as unduly lenient.

bronze · 06/03/2012 15:23

Bit cheeky but can I nick a copy of someones email to their mp. I am rubbish at such things but can adpat quite well
