Things have been slow whilst we are in proroguation, ahead of next weeks Queen's Speech and the EU summit.

We've been in full spin mode, from the likes of the far right and an unnamed source at No.10.

People seem to be waking up to the reality that its highly unlikely we will get a deal now, unless something significant. And No.10 has worked out the NI problem. FINALLY.

Anyway, if you have a little time this week and you are interested in the history of where technology change and fake news meet and how where we are now is merely things repeating themselves, Ian Hislop's Fake News: A True History, is essential viewing.

I really feel strongly this is stuff that should be being taught in schools somehow as its what protects us from extremism.

You're a criminal at the point you're found guilty in Court / plead guilty. Until that point, you're a potential criminal who has the right to test the evidence in Court. This takes month from date of arrest.

I've been dealing with a court case for quite a while
I do not have the faith in the system that many other posters do.

It is still all too easy to crash out on the 31st
and the Benn Act will not stop it, only try to clear up the mess afterwards
murder is illegal, but by then the victim is dead

Yup. I was saying weeks as I would expect an extent of expediency, but using burner phones and lying and using press to mislead/blame etc...

We need to remember this is all an act.

Cummings is always on about systems being reactive. We need to pay attention.

My entire job is about court cases. Just over 1/3 of my case load is litigated. And the one thing I always say to clients, is expect the unexpected. You can lose a dead cert. You can win a lame duck. Civil litigation is subjective to a huge extent (even with case law you can use to support you). And in unique cases like this? If you get an unsupportive judiciary, it's curtains.

But, I'd say that we'd probably be OK with the Benn Act as the obligation is clear. As is when the obligation isn't fulfilled. So I can't see a problem with getting a Court to sort it out. Speed could be the issue.

Now I'm imagining a scenario where we prorogue Brexit and then the Supreme Court subsequently find that it wasn't lawful so it's as if prorogation leaving the EU had not happened, and our MPs MEPs are suddenly back in Parliament... Grin

And then it goes to the European Court, which by then half the country says we shouldn't recognise. Shock

Jail is absolutely a possibility.... Contempt of court doesn’t require separate criminal charges and trial.

@Oakenbeach. That's not a direct consequence of not following Benn. It would be if he didn't then follow the writ which would be sought if he didn't follow Benn.

You've missed a step out. The next step (writ) would be civil. If he breached that, it's criminal (contempt).

Benn >>> writ >>> contempt. Breaching Benn itself does not = jail.

Finding court time quickly isn't always easy. But I'd hope it wouldn't take more than a few days (you couldn't lodge anything at Court until 21 Oct for a start).

Sorry, i realise re-reading that my post at 20:53 wasn’t accurate, and that criminal contempt proceedings would be brought. Given the circumstances I don’t see that would be a drawn out process though.

And that would take time. Possibly beyond 31 Oct. Even if done quickly. Courts can't often turn on a sixpence. I couldn't be sure they would in this instance, can only hope they would.

The courts are SWAMPED. They've cut funding, closed courts, absolutely destroyed the system, frankly. Everything takes SO much time now, even stuff that should be quick.

Milton Keynes County Court has just listed a simple application I lodged a couple of weeks ago in January next year. It buggers everything up for both parties. But that's how things are going. We're getting fast track trials for next summer. Getting from issuing proceedings to a timetable is taking 4-5 months, minimum. Time is a REAL problem.

The poll I posted had No Deal winning over an extension, if there is no agreement by 31 October.

If it's anecdotal - I don't know how many leavers are in your social circle, but my NE family are Leavers
They have steadily got angrier, more determined and more active.

In any case, BJ doesn't have to win a GE against Revoke, just against Labour
He can have Invoke in his manifesto, but as usual the main campaign will be against whoever is the Labour leader

btw, I see if we Remain that we will continue to have referendums on the EU,
because EU treaty updates are being discussed now and will continually be in the future .....
another damn law which Cameron passed requires a bloody referendum each time before we can sign.

This is probably why many in the EU now just want us to fuck off:
they want to integrate further and the UK will be holding up progress on everything.

Iirc, the Scottish court said that it couldn't rule yet as he hasn't yet broken the law and has lied promised that he won't break the law but the court continued the case until the 21st.

So if BJ doesn't send the letter, then they will have something to pronounce on Shock

It's a gamble, but probably all that is stopping him is that BJ loves being PM;
it's his life ambition

Can he delay gratification and tolerate not being PM for say 6 weeks until a GE ?

he'd be the favourite to win

He'd be a Tory party hero for delivering No Deal
and if it happens automatically, he'd escape the possible ructions of having ND in a manifesto

Extensions will end by latest in June, because the EU won't risk the UK buggering up their 7-year budget
and that budget is really impossible for the Supreme Court to rule on

So, even if an appointed court official requests an extension

  • which the EU might refuse anyway, not coming from the PM -
time will eventually run out
