The Tory Party Conference is in full swing in the Manchester Rain, and is proving to be its usual fun.

Johnson is caught up in all sorts of allegations of abuses of power - the non-declaration of his "friendship" to a busty blonde whom was getting a large tax payer grant, and then there the Odey question after his sister said he was under the control of the Hedge Funders.

And thats before we talk about the 40 hospitals, his provocative language and how many times he can say the word surrender.

There is lots of distancing from Lyton Crosby. And accusations that Johnson has gone 'rogue' only listening to the wisdom of Cummings and Symonds.

The Queen apparently has asked for advice as to under what circumstance she can dismiss a PM.

AND NO ONE IS EVEN TALKING ABOUT A DEAL.

I wouldn't get too excited about those figures yet Cendrillon. Remember May's 100 seat majority? We wouldn't be in the mess we were in now, if that had happened.

It is only convention - not law - that failing to pass the QS leads to a VoNC

The Opposition don't have to call a VoNC
and if the Tories do so, then Opposition parties can choose to abstain

True. On the other hand, that was during Corbyn’s surge, before the public (especially Remainers) worked out that he was a clapped-out loon who was a committed Leaver while Boris was still at prep school! Now he’s been exposed, and political lightning tends not to strike twice in the same place. Look at the young, competent, non-socialist Jo overtaking him with a clear Revoke message. Lots of room for optimism this time round...

We need to wait for a pollster from the other group - the group that does NOT has the Tories gaining Northern Labour seats

And of course pollsters can start "herding" as in the GE, i.e. tweak their results to be nearer the others.

I notice HMRCs recent IR35 push has driven Barclays to make all IT contractors "employees" which has pissed some of them off. And a few have now started realising they have less options open to them, as no deal removes their "I'll fuck off abroad" option.

It will interesting to see if other big outfits make the same decision.

In the meantime, Tesco boss in "shock resignation" ...

As for the legal point, a senior No 10 official tells us ‘The EU is obliged by EU law only to negotiate with member state governments, they cannot negotiate with parliament, and this government will not negotiate delay.’ 6/

If this is a threat to fail to comply with the Benn Act, then what this means is that #BorisJohnson will defy the #ruleoflaw and then expect the EU to accept this because they are obliged by EU laws to negotiate with him. 7/

This forgets however that the rule of law permeates the entire Treaty. The EU cannot be expected to collaborate in lawlessness. Article 50 itself mentions that a MS can decide to withdraw from the Union in accordance with its own constitutional requirements. 8/

In Wightman, this requirement was felt to implicitly apply to a change of mind on withdrawal. It seems logical that it would also apply to the question of an extension as well. The rule of law is not dispensible. 9/

Art 50 stipulates that the European Council, in agreement with the Member State concerned, may unanimously decide to extend the pre-exit period. It does not however expressly stipulate that that agreeement/request must come from the UK Prime Minister. 10/

If UK legislation stipulated that in the event of the PM failing to obey the rule of law, an official or parliamentary delegation be empowered to request a Brexit extension, there is no bar in the wording of Article 50 that I can see on this. 11/

If the Prime Minister is defying his own State’s law in refusing to request such an extension, then there would be strong rule of law grounds for the other Member States to comply with the national (UK) legislation concerning who should represent the UK in this regard. 11/

Ultimately, should this scenario play out, it seems likely that the matter would quickly move to the Courts, and more particularly the #ECJ. Ends/

The long and short of the BoJo speech is that he is 'this deal or no deal by 31st October. And there isn't any chance at all of the EU going for his proposals. The 'deal' is designed to fail.

Up to his opponents in Parliament to see if they can force an extension in spite of this.
