Westminstenders: The Rule of Law

We enter week 2 of what might be considered 'the end game'.

The Conservative Party has made it clear that liberals are not welcome in their ranks. It has become the Brexit Party.

Farage is talking of a pact, though Javid has said no. What would Javid know though, he's only in the Cabinet.

Amber Rudd has resigned. She will run as an independent in an unnamed constituency at the next election. The assumption must therefore be she has been talking to a few people this week about this, though whether that means she is a 'One Nation Tory' independent candidate or simply an independent isn't clear.

Some think that her departure will deal Johnson yet another blow at the polls. Others think as the cabinet members with the worst satisfaction rating amongst tory party members this will be viewed positively by leavers and give Johnson a bounce in the polls.

It been reported that Cummings has overruled Johnson on at least key decisions this week which raises the question of who is in charge and running the show.

Cummings has promised to make us all melt in the coming weeks as he takes a sledge hammer to constitutional convention. He's advised no 10 staff to be 'cool like Fonzies'. A reference to pulp fiction and to happy days. As some have commented if you think about Cummings as some one who has watched too much Tarantino it does make him make a lot more sense.

There are suggestions that Johnson will break the rule of law in refusing to ask for an extension and the No10 have a trick up their sleeve over loopholes. The most obvious thing here being to offer the EU a deal they can't possibly refuse agree too to smear them and to then make it impossible for the EU to agree to an extension which noises out of France seem to suggest anyway.

Tomorrow is going to be interesting...

Here it is all about how Trump/MAGA/Boris all common in the same accounts.

fedup21 · 09/09/2019 10:31

I don’t understand how BJ can rule out asking the EU to delay the headline of 31st October-wasn’t that what the very recent vote/legislation was for??

BigChocFrenzy · 09/09/2019 10:32

OK, bellini Maybe Netanyahu was more correct than we think

bellinisurge · 09/09/2019 10:32

Hope not. Still get the odd nightmare about it.

Hazardtired · 09/09/2019 10:36

bigchoc we suffer or die.

Just getting sorted and then I'll poke around futher and contact them because they havent listed dp's current shortage. Will see if they try to sell it to me! I know the prices, it's a cheap med, standard prescription dose is cheaper than the cost of an NHS script. (Unfortunately DP takes quadrupole the starting dose. Typical!)

BigChocFrenzy · 09/09/2019 10:36

fedup He can use every legal trick, every bit of legal authority as PM, to delay until time runs out

  • the time window at that stage would only need a couple of weeks before No Deal happens

Or he could just break the law
and bet that he will win the GE that is almost certainly coming October / November, so he can then change laws to cancel any legal penalty he received

ARoomWithoutADoor · 09/09/2019 10:37

Perking ooh, interesting, thanks.

Basilpots · 09/09/2019 10:39

He can’t. It’s posturing for a certain demographic. Makes him look ‘hard’ in the media. It’s campaigning.

The ‘reamainer’ experts then jump up and down re enforcing the above^

We’ve got at least checks calendar 52 more days of this.

It’s tiresome. I’m fed up with it already.

Basilpots · 09/09/2019 10:43

Also Grin great link.

DGRossetti · 09/09/2019 10:44

In theory, retrospective laws are not compatible with the rule of law. But courts have managed to square the circle on that one more than once, so will be expected to again. This is the danger of making exceptions once.

The US has a similar issue where the president can pardon his predecessor - of anything.

ChazsBrilliantAttitude · 09/09/2019 10:49

fedup
BJ might resign rather than ask
He might call a VONC in his own government to force a minority opposition government to ask

LunarSea · 09/09/2019 10:51

@PerkingFaintly there was a thread on Twitter somewhere about how many Twitter accounts had Trump and Johnson retweet’s in common it was something ridiculous will try and dig it out.

PerkingFaintly · 09/09/2019 10:52

BTW, Red has warned before about getting carried away with the idea that "It's all the fault of those meddling outsiders", and I agree strongly that we can't just pretend this mess is all someone else's fault.

But it's also the case that outsiders ARE meddling, and I think it's important to keep an eye on that – while still recognising they're far from the only factor.

Outsiders find it easiest to meddle along fault lines that already exist. Nobody forced Theresa May to bring in the "hostile environment" while Home Sec; she created that crisis all herself.

PerkingFaintly · 09/09/2019 10:53

Ooh, thanks for that, LunarSea.

Basilpots · 09/09/2019 10:53

@LunarSea

Worth a look folks strips back Johnson’s support on Twitter bare.

BigChocFrenzy · 09/09/2019 10:55

I find it hard to believe even BJ / Cum would call for a VoNC on themselves
It looks weak

BJ could just resign as PM and no other Tory would take over

  • such a case of basically "dumb insolence" towards Parliament isn't really covered by the FTPA or precedent but I'd assume that the 14 days to find a replacement PM would still hold

The Rebel Alliance has more seats that CON+DUP, so if they stick together, they can support someone whom the Queen will ask to become PM

QueenOfThorns · 09/09/2019 10:55

That’s brilliant Alsohuman Grin

Angry puddings!

BigChocFrenzy · 09/09/2019 10:57

If they can't agree a PM, then there will be a GE - and BJ would still be caretaker PM,

so he would choose the election date
and retain all his PM powers during the 5 weeks that Parliament is automatically dissolved before a GE

fedup21 · 09/09/2019 10:58

Love the talk of rebel alliances-they just need to come and rescue Princess Leia and we can get moving!

Basilpots · 09/09/2019 10:59

@PekingFaintly completely agree.

What the meddling outsiders are doing is trying to control the narrative.

Undecideds more likely to go with what they see as the ‘popular’ choice.

Interesting thread on how the two different ‘Tribes’ Leave and remain view the suspension of Parliament.

Couple of surprising results in there.

Basilpots · 09/09/2019 11:10

Fits with the narrative of dying in s fitch though.

Sacrificing himself in the altar of Brexit.

Ditch not fitch.
