Seller apologised and said he would refund,he did not say why he didnt send it,still waiting.I opened dispute but he has ignored it.I paid by cheque, what can i do?

Has the cheque been cashed? If so I'm afraid the small claims court is the only option.

shivermetimbers · 01/12/2008 20:56

yes ages ago.DH wants to go to his house but i dont think that is wise.

Yikes - which seller, name and shame to warn others!!

shivermetimbers · 02/12/2008 08:42

Entertainmentgoodsuk, he has done it to 2 others since me all Wii's.

If he's done it to more than one person, then he's clearly running a fraudulent business and I would inform the police. Perhaps if you email him and tell him that, unless cleared funds are in your account within 7 days you will be involving the police, he might cough up.

I would then inform the police anyway.

shivermetimbers · 02/12/2008 08:54

i did that and his deadline is today.Would the police do anything about it do you think?

OP posts:
misdee · 02/12/2008 08:56

phone the bank. i think you have about 6 weeks from when cheques are cashed to still recall them. might be wrong.

shivermetimbers · 02/12/2008 08:59

thanks, i will look into that.

OP posts:
MrsMagooo · 02/12/2008 11:22

Yes they would Shiver as it's fraud.

I had a similar thing happen to me, discussed it with DH (he's a copper) & off I went to the police station.

The seller who ripped me off is now awaiting her court hearing

Yes also do a Misdee says & phone your bank!

shivermetimbers · 02/12/2008 13:25

thanks for the advice but I suppose there is fat chance of getting my money back from the b*stard before christmas so i can buy a replacement.
makes you wonder if there are any decent people left in this bloody rotten world?

hecate · 02/12/2008 19:54

poor you! he is a bastard of the highest order

shiver (my sister!) has told me that she has found out where he works! If it was ME, I'd be phoning his boss! - i know, i know, but i want to go down there and kick the SHIT out of the bastard. ripping off a KID at christmas.

Bastard bastard bastard bastard bastard

shivermetimbers · 02/12/2008 19:57

thanks Hecate. There is about 3 weeks left and there is no way i will get my money back in time if at all. am very sad and pissed off.

OP posts:
bollockbrain · 02/12/2008 19:58

what a fucking wanker. am for you. Glad you have named and shamed him, and hope you get your money back, which i am sure you will, but hopefully it will be in time to get a new one.

hecate · 02/12/2008 19:59

i think we should all email him, calling him a crooked bastard!

bollockbrain · 02/12/2008 20:04

or we all just mess up his ebay by bidding in ridiculous amounts of money for his stuff then withdraw the bids or something.

how do we find him on ebay?

bluebump · 02/12/2008 20:11

bollockbrain, if you go to search and then advanced search options you can search for sellers there.

bollockbrain · 02/12/2008 20:14

ok will go and have a poke about

NCRedBreastedBirdy · 02/12/2008 20:20

He has nothing else for sale.

It looks like he had 1 wii and listed it 4 times at the same time.

on your behalf, go to the police please, there are too many people who get away with it because people write it off as "thats the risk you take on ebay"

bluebump · 02/12/2008 20:21

I must be blind and can't follow my own advice as I couldn't find him

bollockbrain · 02/12/2008 20:27

i found him and he had a previous id from march this year as bigtopebookshop but could not find what his feedback was from that id.

He changed to entertainmentgoodsuk on 1st october. Reckon he thought he would be able to make a quick buck on the wii consoles and was unable to get hold of them to sell.

In which case he should have refunded immediately, and in fact should never have listed items he did not have in his posession in the first place.

complete tosser.

NCRedBreastedBirdy · 02/12/2008 20:45

BB, I think the feedback is carried over to the new ID isn't it?

bollockbrain · 02/12/2008 20:48

oh i see, then he seems to have onlly been a naughty boy in recent weeks over the nintendos. If he does live near you, there is no reason why you cannot do a drive by and ehck him out before you punch his lights out

NCRedBreastedBirdy · 02/12/2008 20:49

Yes, his feedback runs from the beginning of the account.

I do rather like the neutral that says "not the best to understand" yes, because that comment is soo easy to decipher!

TequilaMockinBird · 02/12/2008 20:56

He's not far from where I am, does he have a business do you know? A shop or anything where he also trades from?

hecate · 02/12/2008 21:32

she's off watching survivor atm
I do know he lives a fair distance from them, but her husband is still on about going down (take a couple of mates is my advice!! [only half joking emoticon]
