Am going to get told off i think but......

My ds has special needs and particularly likes Fireman Sam, He chose a video the other week when he was at home, we won it and with p and p it was £3. When he came home on Friday and put it on it was the wrong video the box said Best of FS and the tape inside said Best of FS volume 2. I emailed and offered to send it back for a refund they replied that they had said the right one, i then tried to explain again and pointed out how sad my son was, they then replied that they knew it was right because it didnt say Postman Pat or Bob the Builder For a third time i tried to explain and they told me to get a life. Its not the cost of the tape, its the fact that my son was sad and that the guy was rude to me, i took it to dispute and he has now said if i give reasonable feedback he will refund me and if i dont i dont get my money and he said it in a threatening way,... do i ask for refund then say i'll give feedback. Sorry if people think i am being petty but my son was soooo disapointed about it.

I'd report his agressive behaviour to be honest. I don't think it's about the tape anymore.

He sounds like an arrogant pig.
I dont know the ins and outs of ebay, seems wrong you cant leave honest feedback AND get a refund.
I fyou can do without the money, it would be worth it just for the pleasure of leaving him neagtive feedback.

I wouldnt leave feedback for this person without getting your money back, as once you have left feedback i dont think you will have any further comeback if he then refuses to refund your money.
But from what you have said I dont think this man will refund your money without you leaving feedback.
Difficult situation. I have never managed to get a positive outcome in this sort of situation, it has happened to me twice, and both times I have lost my money and had to leave negative feedback.

Why would anyone think you're being petty? You bought an item in good faith and they sent you the wrong thing. They should send you the right tape and refund your postage. You have given them the chance to put things right and they havn't. Report them to ebay and leave factual, calm negative feedback.

I'd report it - did you pay by paypal? if so raise a dispute as item wasn't as described. can you do a link with the item and we can see what we think?

your poor ds, though. If I had a fireman sam video I'd send you one.

he'll neg you even if you leave ok feedback
use ebat to settle dispute. Then when resolved leave factual feedback.
ie: crazy bastard psycho

don't give in to the blackmail. Open a dispute, see it through to the end (remember to return using trackable)
Report his messages to ebay.

lottiebelottie, when i opened the box, i saw it was fireman sam and thats why i posted it, now if it had said thomas the tank engine or bob the builder i would have taken it out ...

tell him you'll leave a truthful feedback, ie item not as described but refunded, if he does so (refunbds) today, and tell him its not the money its the principle, if you'd wanted that version you'd have bought it.

I think from the 1st of May he cannot leave you neutral or negative feedback but you can leave negative feedback. For once I can see why Ebay changed the feedback rules.

To leave him negative feedback without worrying about him leaving it for you... you wait until the very last moment of the 90 days you have to leave feedback, then you can leave him negative and he won't have any time to leave you any in return..a trick a friend told me.....

Hmm, I personally would report him and also leave him negative feedback. Hopefully you would get the money refunded too but I would think it well worth £3 for him to get his comeuppance!!

the seller not being able to leave neg or neut for a buyer doesn't happen til later this month. The 90 day trick doesn't always work as many a time you can still leave feedback weeks and weeks after the 90 days.

"Dispute Console" is in the list to the left of the "My account" page, which allows you to report an item not as described...but have you done this?
