Refund after left positive feedback?

Being a bit of a silly woman, I left positive feedback for an item I hadn't fully tested.

Further use has shown it is definitely not in the "immaculate condition" promised.

I've raised a case with Ebay after messaging the seller but she is saying she won't refund as I left positive feedback and I didn't raise the case until 40 days after I bought it.

So...have I lost £150?? I know I was stupid leaving feedback. Could kick myself now Blush

What does the feedback say? Does it mention the item, or just say fast delivery etc?

That's a long time after purchasing, too. Not in any way saying that you are, but if I were that seller, I'd assume you damaged the item and are trying it on :-(

I know. It looks terrible on me. I'd think the same if I was the seller tbh.

Lesson learned. I'll just have to swallow the loss if it comes to it. I can't even sell it on.

I'd say after feedback and almost 6 weeks you are unreasonable to pursue a refund tbh. I suspect ebay will say the same but you never know, they are pretty buyer led. Any chance you can resell to recoup some of the loss?

I couldn't sell it on. I'm too honest. And selling it as faulty would get me a tenner at the most.

I obviously don't want to say what the item is as the seller could be a mumsnetter (paranoid much?) but lets say it's a mobile phone (it's totally not).

So I get the phone, it switches on, looks ok and makes calls. All ok. But then I get used to the phone and want to use the internet, bluetooth, etc and find they don't work. Plus it's a bit battered now I look at it properly.

That's the type of reason I can't sell it on. It's worthless.

How many days is it exactly since the transaction? Depending on the circumstances, you might have 45 days to open a case with Paypal.

What about taking it to the manufacturer? It's still supposed to be functional for a reasonable amount of time?

Sorry, been busy with DCs.

It was 42 days since paying for it that I contacted the seller with my concerns. Got no reply and then opened the case via the Ebay Resolution Centre as I knew time was nearly up.

Laurie it may be fixable and it is an electrical item that is meant to last for decades if looked after. It's practically vintage. The seller has now contacted me via Ebay to say I should pay to get it looked at/fixed as she thinks I'm just trying it on.

But I am reluctant to do this as I paid more than the usual going rate as it was advertised as being in such well preserved condition. God knows why I'm always in a rush to leave feedback! I'm such a people-pleaser.

Have a look at this OP:

You have 45 days from the date you made the payment to open a dispute.

In your shoes I'd try to open a dispute with Paypal. It is possible that you've taken a step with ebay that might prevent this but you have nothing to lose and you might get your money back.

yes of course you should open a case - and any feedback you left is irrelevant. I don't understand why you are concerned your feedback left has any bearing - it makes no difference at all.

She's making a big deal of it, that I can't possibly expect a refund after leaving positive feedback. She's quite aggressive in her communications. Lots of CAPS and telling me I have buyers remorse and am trying it on because I've changed my mind.

I've just replied sticking to the facts and asking for a refund.

champtastic I agree with Chrissy41 on this you obviously did not have time to fully check the item and took it on face value I have done this myself only to find a problem at a later date but certainly not to the value of £150.00 and of course the seller is going to be aggressive with that amount of money involved.
Do everything through the resolution centre and don't communicate with her any other way,e-bay will also be able to view any e-mails she has sent you and make their own opinions about the tone of her communications with you.

PayPal rules have changed....You have 180 days to open a case, partly for this very reason because 40 days isn't always enough to be certain something is working as it should be.

I've lost. Ebay say because I opened the case after 30 days they will not refund and they cannot get it back from the seller.

It was a sewing machine. Described as in mint condition. On first looks it was ok. I sewed a straight stitch on it. Left feedback. Seemed fine. I'd just taken up sewing to learn to make simple clothes for my autistic son as he has sensory issues and finding shop bought stuff he can tolerate is getting impossible.

Didn't touch it again for weeks as I had booked sewing lessons. I took the machine along and it appears straight stitch is about all it was capable of. The thread cutter was blunt - the listing said it had been used 3 times. The needle threader was bent and broken. The sewing bed was discoloured pale pink (stock photos had been used for the listing) and none of the other stitches worked properly no matter how much we followed the instruction book or adjusted tensions etc.

The inside was filthy as well.

This was a professional dressmaker and designer looking at the machine, not some novice. I am so angry with myself.

Paypal won't let me open a case as it's still open with Ebay. Ebay have asked the seller to resolve it again but have admitted the seller can just ignore me for 30 days then the case will be closed, no refund and my 5 star stupid feedback will remain.

I feel sick and it's my own fault.

Pity party at mine. Bring an orange juice. I don't even fucking drink...

Are you sure none of that can be repaired? Not cheap, I know, but might get you a working machine. What brand is it?

Ok, physically call ebay. The new 180 day rule is just for these scenarios. If (and it is an if) you get the customer service advisor with the brain cell for the day you might have more joy.

Keep on to them, £150 is a lot of money to give up at the first hurdle so keep pushing.
