Refund after left positive feedback?

Being a bit of a silly woman, I left positive feedback for an item I hadn't fully tested.

Further use has shown it is definitely not in the "immaculate condition" promised.

I've raised a case with Ebay after messaging the seller but she is saying she won't refund as I left positive feedback and I didn't raise the case until 40 days after I bought it.

So...have I lost £150?? I know I was stupid leaving feedback. Could kick myself now Blush

flack the dressmaker was a fashion graduate and pattern designer who tutors at universities. She has over 20 years experience. I found her whilst looking for someone in the local area who could give me tution.

It's a Janome. It can probably be repaired but in the meantime I have had to buy another machine as I was committed to my lessons. What gets my goat is the item was not as described so the seller should pay.

Sisters I have called Ebay. They are saying if the claim had been lodged within 30 days I would have got a refund. As it is and even though they agree I had 45 days to raise the not as described case (which I did meet) the only way to get a refund is if the seller agrees to it.

Champ call again, what you have been told is utter bullshit. You met the 45 days for the claim let alone the new 180. Keep on at them, seriously.

Ebay say 45.

It's Paypal that say 180 isn't it but they won't let me open a case as it's open with Ebay. Plus I think the new 180 day rule came in AFTER I had bought the sewing machine so it won't be covered by the new 180 day rule will it?

The 180 is probably a red herring, the fact is that you were still within the 45 days when you opened the case.
Ebay reps all sing from different hymn sheets and telling you that you only had 30 days is laughable.
Call back and pray you get one that does know what they are doing.

Not sure I is covered, but if you paid by credit card through PayPal, are you covered by credit cards refund rules?

You may be as well taking it to a sewing machine service engineer. The faults such as blunt cutter/bent threader can be easily rectified/the colour of the foot bed is irrelevent to how it will sew. As you say is almost vintage but has only been used 3 times sounds to me as if it is virtually 'seized up'
as the other stitches may not have ever been used. Is your teacher actually experienced in the repair/service of sewing machines or is she just very experienced in using ones/setting them up when they are in perfect order?

To be honest it's quite a few decades off 'almost vintage' Grin. That was me trying to keep details of what it was non identifiable/put the maybe Mumsnetting seller off the scent. It's actually a 10 yearish old machine but it had the variable speed control and the stitches I wanted. If it was in mint condition, it should have sewn every stitch right out of the box.

I'm on hold to Ebay again. Supposedly for the Resolution centre.

I agree the thread cutter etc can be overlooked. I was prepared to let those issues pass if the damn thing worked!

My teacher has everything from a hand crank, treadle, early Singer and Viking to a modern day Pfaff and an embroidery machine.

Same answer from Ebay. The claim had to be filed within 30 days for it to be eligible for escalation or money back. The seller can ignore me and the case will auto close in 30 days. They cannot remove my positive feedback.

Ebay say Paypal won't open a case as I opened it with Ebay. Once you open a case with either Ebay or Paypal, you can't do a claim with the other.

Seller wins.

I'm going to take a hammer to the fucking thing because even if I spent money having it fixed, I will hate it every time I use it.

What date did you receive the item on? And what date did you first contact the seller?

not quite over - have you considered small claims court? And def investigate the Verified by Visa on your card you paid with too.

Can you leave follow up feedback still? There used to be an option to leave further comment. So although the positive wouldn't change if someone read the feedback they would see the seller was dishonest in the description.

Help I left follow up feedback stating problems had been discovered with the purchase since using it fully. The seller had it removed by Ebay and they are refusing to re-instate it.
