I reported a buyer for feedback extortion.

I've received this back from ebay CS

"I gathered from your email that the buyer has threatened to leave negative feedback on your account if you will not send them money.

We've looked into the situation again and can see that this isn't a case of feedback extortion"

I cannot believe this. Yes- I would contribute too... and what a joke of a judge. Ask for an appeal- and someone who knows ebay this time! Say that the case was unfair as the judge hadn't read your papers.

Will you get a CCJ for not paying?

If I were you, I would also seriously think about complaining to the court itself that they lost your papers 3 times and that this adversely affected your case as the Judge did not have the opportunity to read your papers beforehand.

In my experience (which can't be proven, of course) that will not have helped you at all. A complaint should not affect any appeal or any other dealings with the court. It is ridiculous that your papers were lost so many times.

Is there anyone legal on here who can advise you? How is it possible that a judge is able to make such ludicrous decisions based on faulty knowledge?
It's good you have a recording. Are judges actually regulated by anyone to whom you can put in a formal complaint? Perhaps you could send them a transcript of the hearing along with a point by point breakdown of the mistakes?

I'm shocked that this has happened, it really is completely farcical.

mind you I have encountered very unfair situations before so it is somehow not THAT surprising, just that really, what the hell can you even do about it when this happens?

It won't put an end to it though. They intend taking things further with regard to me being dangerous. Lordy knows what court summons will arrive through my letterbox next!

heh, my ds has just walked out of the room telling me he is going to start typing the transcript but while he is gone I have to promise not to murder anymore people in Preston Grin

before we went into the chambers, I turned around and saw Smith glaring at me. He had pure hate in his eyes. Throughout the hearing he did nothing but attack me (in a real threatening way) about things that were lies and irrelevant. That man hates me HATES me.
I reckon i am the first woman who has stood up to him (via email) and therefore he hates me. Fruitloop didn't want to there. It was obvious. I reckon (as some here have already said) he is behind all this and he has forced fruitloop into this; making her sign the cheques for each stage etc. She looked dreadful by the end of it. It wouldn't surprise me if he is not battering her right now :(

You can and should appeal the judgement on the grounds that, 1, the judge did not have your papers and had therefor not read any of your evidence or defence, which could have biased him towards the plaintiffs, 2, the judge did not know eBay/PayPal policy and therefor was incorrect to make a judgement based on personal options (or those of his friend) about how eBay policy should be.

It has crossed my mind to go to the courts tomorrow and ask if my papers had been passed to the judge - to try and obtain proof that he hadn't seen them.
I can pay for the official transcript and so this should indicate that he didn't have them. I need to sleep on this and make decisions in the morning.
