Selller wants to delay refund - advice pleaseandthanks?

I bought an ipod on Ebay for DD (Christmas) - it arrived with one very feeble layer of bubblewrap in a jiffy bag and is very firmly not working. I've tried charging it every which way, re-setting it - nothing. The best it shows is an error message which I've googled - Apple say likely hard drive problems.

Seller says it was working fine and they will refund, but not for another fortnight as they're away. I'm a bit pissed off at this tbh - surely you can access paypal if you can access emails? - and a bit worried about it all going on so long.

Should I open a case with Ebay? Or do nothing for the fortnight?

I'd be opening a case with eBay in your position.

Open a case with eBay. It stops them turning round and saying 'why has it taken two weeks to file a complaint' and blaming you for the damage

Do you think so? I don't think it's damaged tbh (more by luck, given the packaging) but just not working.

They are trying to con you, Sue. Open the jeffing case pronto. You'll get a full refund as soon as they figure out you're on to them. And if not, wbay will refund you.

You gave the seller every chance to do things the right way, Sue. Any half decent private seller can get to a computer or device and log into their PayPal account, and make the refund.

If the seller is unable to do it, then you are simply asking EbaY to do it for them.

You need that money back for your Christmas shopping.

I am thinking seller has a cash flow problem, they have already withdrawn the Paypal balance to spend.

Thats OK though - it shows ebay that you have a complaint about it working straight away - I think the seller was waiting so they could claim it worked and you then broke it, hence the delay in complaining. See what I mean? You've done the right thing, mate.

I think the buyer is likely to be short on cash. I was on the other end of this a few months ago. sent out a netbook, buyer said it didnt work. I knew it did (and sure enough, when she sent it back it worked perfectly wanker) but I didnt have the cash to refund straight away.

Of course, the seller may be away and reluctant to refund until they have the ipod back. I certainly wouldn't refund until the item had been returned.

She hasn't asked me to return it - neither have Ebay. I will obvs, I was just waiting to be told IYSWIM. I've only done this once before, for a smashed toy, and in that case, the case sort of went through steps iyswim, one of which was me posting.
