DLA Mandatory Reconsideration 2023

Hi, I’ve been following the DLA wait times thread since I applied for my 7 year old son in October. We had the decision yesterday and it was declined 😭 I was absolutely devastated.

We applied because my son was involved in a serious RTC (we were going on holiday with our friends, he wanted to travel in their car following us, a car came round a bend missed us but hit them head on) understandably he struggles with the fact he was the only one in the car and blames us for letting him in there). He was the only one awake and conscious in the vehicle, he has chronic flashbacks, normal everyday life things (sirens, bangs, travelling, weather conditions and so on are triggers) they send him into a state of survival and all his rational thinking is gone. Nights are horrendous for him, he lives like his life is in constant threat, he fights sleep and often gets dressed in the middle of the night so he’s ready should anything bad happen. Flashbacks are more prominent through the night.

school are aware of his issues. Now he’s under CAMHS school have been asked to stop any mental health interventions as this could interrupt the trauma therapy. hes happy at school because of the structure and routine, no real unpredictability etc.

anyway I’ve done this tread for anyone going through MR and hope we can all support each other through the process!

xxx

@Beckylouise000 yes in line with what others have said on here, I think a decision will made this week x

Mummytomarley11 · 12/06/2024 12:11

I did just call and was told the wait is 13-14 weeks at the moment

Beckylouise000 · 12/06/2024 13:34

@Mummytomarley11 fingers crossed for us then!I might wait and ring up next week to see if they’ve made a decision!x

Beckylouise000 · 17/06/2024 10:31

Anyone had any good news? Week 14 now😩

Mummytomarley11 · 17/06/2024 11:12

Still waiting 😩 I desperately want to call but I feel like I have pestered them a lot lately x

Mummytomarley11 · 17/06/2024 12:03

I gave in again 😂 my sons mr is with the decision maker now.. they said to call back in 2-3 weeks if I haven’t heard anything because they can’t give a timeline. No doubt I will call back at the end of the week as I didn’t submit loads of extra evidence, I just contested their points x

Beckylouise000 · 17/06/2024 12:46

@Mummytomarley11 the wait is getting ridiculous now!ive been waiting over 30 weeks from putting the first initial claim in, hoped this part of the process would be a bit quicker lol x

Hi, hope your well I just wanted to say good luck hope you get what your little one deserves, and id call back again Friday mine was with dm and seen literally the same day as they told me to call back in a few weeks, I don’t know why they tell people that. I called one day was told it’s with dm call bk in a few weeks I called back next day as I feel you have to be persistent, and they said a decision has been made xx

Mummytomarley11 · 17/06/2024 15:00

Yeah I think we are coming up to 38 weeks from posting the original form… CAB said to me when I asked for their help with the MR it more than likely won’t be overturned at MR so it’s so annoying that this part has taken so long, especially when the wait time when I applied for MR was supposed to be 7 weeks 😫 fingers crossed for an answer by the end of the week x

Becklouise00 · 20/06/2024 16:37

@Mummytomarley11 you had any news at all yet Hun x

Mummytomarley11 · 20/06/2024 19:11

@Beckylouise000 i called this morning and they said it’s still with a decision maker x

Starlight0212 · 21/06/2024 14:00

kaysash86 · 21/06/2024 17:08

I called today and they said decision was made on Wednesday and I have to wait for the letter. They couldn't tell me on the phone. Does that mean it's a decline?

No it doesn’t, they are saying that a lot lately. I was told the same, that they couldn’t tell me over the phone. But once it had been a few days and I didn’t receive the letter I called back up and asked to be put through to someone who could tell me and they then told me over the phone my daughter had been awarded x

Thank. Oh that's hopeful then. It's so draining the wait.

Mummytomarley11 · 24/06/2024 09:29

Decision was made on the 22nd, unfortunately not what we wanted. I would say it’s worth you ringing now @Beckylouise000

kaysash86 · 24/06/2024 12:34

I got backpay this morning. So it seem MR has been successful. I will have to wait on the letter to see the result though. I initially got MRC and LM so maybe the care has now gone up to HRC. Good luck everybody still waiting!

You have to do a Mr before you can go to tribunal.

We went to tribunal and won. We had the evidence to back up each point but the DWP clearly didn't read it. We sent over 100 pages. The judge in the tribunal asked us no questions at all and awarded the higher rate for both as it was clear our child was entitled to it.

Hi I've just been awarded, I'm doing an mr, I was just wondering do the payments stop whilst this is going on ?

Beckylouise000 · 04/07/2024 16:35

I received a phone call today asking some more questions I'm currently week 16 of an Mr, they asked about help in the night etc anyone else had this and is it positive looking?so over this process now
