DLA Mandatory Reconsideration 2023

Hi, I’ve been following the DLA wait times thread since I applied for my 7 year old son in October. We had the decision yesterday and it was declined 😭 I was absolutely devastated.

We applied because my son was involved in a serious RTC (we were going on holiday with our friends, he wanted to travel in their car following us, a car came round a bend missed us but hit them head on) understandably he struggles with the fact he was the only one in the car and blames us for letting him in there). He was the only one awake and conscious in the vehicle, he has chronic flashbacks, normal everyday life things (sirens, bangs, travelling, weather conditions and so on are triggers) they send him into a state of survival and all his rational thinking is gone. Nights are horrendous for him, he lives like his life is in constant threat, he fights sleep and often gets dressed in the middle of the night so he’s ready should anything bad happen. Flashbacks are more prominent through the night.

school are aware of his issues. Now he’s under CAMHS school have been asked to stop any mental health interventions as this could interrupt the trauma therapy. hes happy at school because of the structure and routine, no real unpredictability etc.

anyway I’ve done this tread for anyone going through MR and hope we can all support each other through the process!

xxx

Mumzieof1 · 23/04/2024 22:03

Hi all, don't give up hope. Just to update you, I rang for forms 29/06/23, refused DLA in Nov, sent MR in the received Dec, MR was declined in I think Feb or March, logged a tribunal, days before I logged it my little one received an ASD diagnosis so sent that in too. The DWP had up till this Friday to respond to me, I received a call today from them asking me a couple of questions and offered me low rate mobility and high rate care! I can't believe it, from no award to that. Never give up for what your children deserve!

jellycat12 · 23/04/2024 23:02

@Homesweethome93 I haven't a clue hoping it won't be much longer.

@Sarahdestiny sorry to hear fingers crossed for the next MR decision and don't give up hope.

@Mumzieof1 that's really good news sham it took all the stress but glad you got a good outcome x

Sorry to hear, once you get your MR notice log an appeal for tribunal. The DWP will have 28 days to respond to the appeal. They rang me 3 days before the response date and offered award, no award to lrm and hrc. Absolutely bizzare. People will also tell you they wont take new evidence into account, ignore them they do as long as all linked to original claim. My daughter received an asd diagnosis a few days before i logged appeal and they used the guidelines for asd along with other evidence to award me, i was told by loads they wont look at it but she did and obviously it was an explanation for all the behaviours id put on the form, an she hadnt even had a referral to the asd pathway at the point i sent the form. Good luck x

Sarahdestiny · 30/04/2024 08:05
