DLA Mandatory Reconsideration 2023

Hi, I’ve been following the DLA wait times thread since I applied for my 7 year old son in October. We had the decision yesterday and it was declined 😭 I was absolutely devastated.

We applied because my son was involved in a serious RTC (we were going on holiday with our friends, he wanted to travel in their car following us, a car came round a bend missed us but hit them head on) understandably he struggles with the fact he was the only one in the car and blames us for letting him in there). He was the only one awake and conscious in the vehicle, he has chronic flashbacks, normal everyday life things (sirens, bangs, travelling, weather conditions and so on are triggers) they send him into a state of survival and all his rational thinking is gone. Nights are horrendous for him, he lives like his life is in constant threat, he fights sleep and often gets dressed in the middle of the night so he’s ready should anything bad happen. Flashbacks are more prominent through the night.

school are aware of his issues. Now he’s under CAMHS school have been asked to stop any mental health interventions as this could interrupt the trauma therapy. hes happy at school because of the structure and routine, no real unpredictability etc.

anyway I’ve done this tread for anyone going through MR and hope we can all support each other through the process!

xxx

Hi. Wondered if anyone could help. I've filled in the tribunal thing online but was confused whether it's my details, national insurance number I should have filled in or my daughters. Thanks

Did you do it in writing? Or did you phone up?

jellycat12 · 02/03/2024 18:18

@kaysash86 I phoned up on the 12th but also did one in writing and reference it to my phone call

Ok thanks. I phoned up as well but the person on the phone said something about it better being in writing. He did not listen to the reasons why I am doing a MR, he just said he will put a note on the file. I posted the form with supporting evidence on thursday and it was signed for on Friday. But I am not sure how long it will take them to actually scan it on the system. Sigh. I hope it's not too long a wait.

Lou84lou · 02/03/2024 21:23

@kaysash86 I’m on week 9 of MR and still haven’t heard a single thing except for a letter to say it could take up to 15 weeks 😢

Lou84lou · 02/03/2024 21:40

@Mumzieof1 have you heard anything yet?

I heard Friday, had a phone call. It was exactly 11weeks. I don't know the outcome yet though 😩

Hi, I forgot to update this thread, my MR was not awarded. I rang Fri 23rd Feb to check they received extra evidence, the lady advised me yes and mine has been 9 weeks and not even with a Dm an should only be taking 7 weeks so she said she would email the MR team. So I rang on Thursday 1st March to advise them off an appointment to be told by the lady my MR was not awarded on 23rd Feb!! So the same day I rang and they was emailed they declined it, yet I was told MRs will be with DM for a couple weeks as all evidence looked through again yet they seemed to have my MR for a few hours if that! I received the MRN and I have started the process for tribunal. She has ASD assessment next week so trying to hold out for results of that if I can, if not everything will be sent by 23rd April. Good luck everyone 🤞

Madmummy2016 · 05/03/2024 18:48

Got a phonecall today to say my child's MR has gone from nothing to middle rate care. It took 12weeks & 1day. Good luck everyone!

Quick question my son has been accepted for a blue badge .. if I send this to dla do you think that will be good enough evidance towards the MR for high mobility thanks x

Hi no blue badges don’t do anything for dla altogether, I’d still send it in though I have but I’ve spoken to many professionals including dla themselves who have said getting a blue badge doesn’t help towards it

Lou84lou · 08/03/2024 20:47

@Madmummy2016 did you send more evidence for MR than you did first time around?

The same happened to me within half an hour a decision was made which I think was a joke and then I don’t my tribunal appeal online they overturned decision before tribunal. Now I’m doing a mr for the renewal whole process is a joke. I think they need to make a change and maybe go digital that way we can track things upload information might make it more easy!
