DLA Mandatory Reconsideration 2023

Hi, I’ve been following the DLA wait times thread since I applied for my 7 year old son in October. We had the decision yesterday and it was declined 😭 I was absolutely devastated.

We applied because my son was involved in a serious RTC (we were going on holiday with our friends, he wanted to travel in their car following us, a car came round a bend missed us but hit them head on) understandably he struggles with the fact he was the only one in the car and blames us for letting him in there). He was the only one awake and conscious in the vehicle, he has chronic flashbacks, normal everyday life things (sirens, bangs, travelling, weather conditions and so on are triggers) they send him into a state of survival and all his rational thinking is gone. Nights are horrendous for him, he lives like his life is in constant threat, he fights sleep and often gets dressed in the middle of the night so he’s ready should anything bad happen. Flashbacks are more prominent through the night.

school are aware of his issues. Now he’s under CAMHS school have been asked to stop any mental health interventions as this could interrupt the trauma therapy. hes happy at school because of the structure and routine, no real unpredictability etc.

anyway I’ve done this tread for anyone going through MR and hope we can all support each other through the process!

xxx

@4girlswithatwinkle I was also told my 13 year old is on the same level as her peers, she most certainly is not, I can assure them that but I am thinking it's another decline as the MR has been a 9 week wait now. CAB helped me with the MR and I was advised that she should qualify with what I told them, trying to keep a little bit positive though.

It is so difficult.

I'm currently photocopy the screening packs that were sent to camhs last year home/ school ones his shared cared agreement with gp and paediatrician confirmation that were on waiting list for family support worker letters from camhs unsure if to even send letter from 2017/18 when he had oral difficulties and all previous rejection letters from camhs? To show how long this has been going on for?

I would. I'd send the lot honestly. Give yourself the best chance because I'm now kicking myself that I didn't.

I've got everything crossed for you. It's so easy for them to make decisions without seeing for themselves what we go through.

I did the form myself so maybe that's where I've gone wrong

@4girlswithatwinkle it's awful isn't it, but I'm very much in the mind frame of if I don't fight for her, who will. It shouldn't be a continued fight should it. Keep going with it.x

Sarahdestiny · 12/02/2024 20:28

Quick question when you send the mr do you get a new letter with a new scan date once you've sent it back to them x

I'm really not sure. I never heard a thing (not even a letter to say they received the mr) until last week when they phoned me

Sarahdestiny · 12/02/2024 20:35

@4girlswithatwinkle oh right okay thank you for your reply x

I think I've lost the will to fight to be honest. Don't know what else I can put or do to get an acceptance.

I really hope the fight ends here for you and you get an acceptance

82cem · 12/02/2024 22:21

@Sarahdestiny from what I understand, once you send the MR back it is looked at by a fresh decision maker and if awarded it will be backdated to the original scan date. I didn't hear a thing when I sent mine back, I saw that it was signed for on the 11th December so I rang to make sure it was scanned into the system. He told me it was actually put in as a new claim so changed it to an MR. He also told me they don't tend to communicate as they would with a new claim, why is why we don't hear anything after and MR. Hope this helps.

They have now advised its been sent to the DM to decide if it will be back dated

82cem · 14/02/2024 19:06

I have received my MR notice today, my daughter is in no way shape or form entitled to DLA, she is the same as any other teenager! It's so saddening that someone who doesn't know you or them makes that call.

within the week you’ll get it. From there they always do that mine was with a dm for over a week. But it should all go in together even if you have been paid they don’t do it on your payment date if the miss it

Sarahdestiny · 15/02/2024 15:55

@Dla96 hi wondering what sort things wrote or sent as evidance and what condition is it your child has ..any help will be much appreciated as just sent mine today for hrm from lrm thanks 😊

Lou84lou · 15/02/2024 17:29

@82cem can I ask what condition your daughter has , if ASD what evidence did you send?

82cem · 15/02/2024 18:12

@Lou84lou I sent off reports, school plans, immediate family statements. With their reply for the MR I feel like they've just ignored what I've said and picked out 'good' statements. It all just said 'she requires no extra support than someone similar in age' they rang school but not me, I would like to know who they spoke to and if this person knows my daughter on a day to day basis as she masks incredibly at school so they don't see what goes on at home.
She is extremely sensory and really struggles with noise, crowds, smells, textures. They told me if she was somewhere unknown she would know how to get around but despite me telling them twice that she would be highly over stimulated by this, wouldn't know what to do and go into meltdown, they said she needs no extra support. I really want to appeal it but if they haven't overturned it with extra evidence at this stage I feel it would be a losing battle. I do understand that it's not based on a diagnosis, it's the extra care throughout the day but my 10 year old, who my daughter heavily relies on, is more capable in general life skills etc and I feel my 13 year old is in no way on a level with her peers.
I don't want to take up too much space here but I could on with how I disagree with their reasons.x

Lou84lou · 15/02/2024 18:34

@82cem has she been referred for an assessment? I’ve got my daughters head of year to do me a personal letter of how she sees my daughter at school and the plan they have in place for her. I also completed a timeline of how a night goes with her and how many times she wakes and needs assistance at night etc. she’s 12 and needs me to wash her hair, shave under her arms and legs and needs total prompting at all times. She’s very regimented with regards to specific times. She needs guidance during menstration too and prompting with hygiene including feminine hygiene. I sent off the initial asses ment with the social worker at the gp practice who then sent the referral off for assessment and then I sent the letter to say she was now on the waiting list for assessment. I didn’t have all this information before I was turned down the first time so I’m hoping all this new evidence will stand for her. Like yourself she is by no means as able as her piers!

82cem · 15/02/2024 20:13

@Lou84lou she was diagnosed when she was 7/8, with traits becoming very apparant from I'd say 18/24 months. It was nursery at aged 2 who wanted to put the initial referral in but she was then going to school nursery so got the ball rolling once there. I did everything school asked me to i.e hearing tests etc as they said she wasnt present, referred to cahms who then did the autism referral as she could see from the short time we spent with her that there were traits present I wish I had applied much sooner for dla but someone told me she wouldn't get it so put me off, but recently I've thought she is deserving of it and it would really help with putting some activities in place for her to help with regulation but it looks like they were right. I was advised from CAB that she would be eligible.
I also put in the same ie, she needs reminders/prompting etc every day of personal hygiene and also time of month, they told me this no different of that of someone of a similar age.
The more I read the MR reply, I feel should appeal it. Fingers crossed for you.

Gutted for you 😔.
Well gutted but also annoyed because if your daughter is anything like mine the decision seems so wrong!!
I feel like sending photos in as evidence of some of the things she does hygiene wise.

82cem · 16/02/2024 19:58

@4girlswithatwinkle when looking at information she covers the criteria for mrc and lrm and those were what CAB told me she would be eligible for too when I spoke to them. I don't feel like anything I sent has been acknowledged at all.
