DLA Mandatory Reconsideration 2023

Hi, I’ve been following the DLA wait times thread since I applied for my 7 year old son in October. We had the decision yesterday and it was declined 😭 I was absolutely devastated.

We applied because my son was involved in a serious RTC (we were going on holiday with our friends, he wanted to travel in their car following us, a car came round a bend missed us but hit them head on) understandably he struggles with the fact he was the only one in the car and blames us for letting him in there). He was the only one awake and conscious in the vehicle, he has chronic flashbacks, normal everyday life things (sirens, bangs, travelling, weather conditions and so on are triggers) they send him into a state of survival and all his rational thinking is gone. Nights are horrendous for him, he lives like his life is in constant threat, he fights sleep and often gets dressed in the middle of the night so he’s ready should anything bad happen. Flashbacks are more prominent through the night.

school are aware of his issues. Now he’s under CAMHS school have been asked to stop any mental health interventions as this could interrupt the trauma therapy. hes happy at school because of the structure and routine, no real unpredictability etc.

anyway I’ve done this tread for anyone going through MR and hope we can all support each other through the process!

xxx

Oh does it! Oh no, so is this after the mandatory reconsideration if you send anything in once you've done that? I might ring them to say to dispose of the 2 new pieces I've sent last week. X

Did you fill in the form or did you send a letter in or do it over the phone ? X

Homesweethome93 · 10/02/2024 12:54

This is the form you fill in and it’s the same form they fill in on the phone, it tells you there

I just sent in a letter with the extra info then rang them again last week to say I had more and she said send it I'll put a note on to hold of. I'm worried now x

jellycat12 · 10/02/2024 13:34

@Mumzieof1 exactly what I'm doing I was told I'd lose the back pay x

1tiredmam · 10/02/2024 16:57

I just sent in a letter. I told them i had information to show why I thought their decision was wrong.and the gentleman told me to send it in within 5 weeks. How can you fight a decision without providing the evidence of what you are saying. Even on the help guide it tells you to send in more info

Are costs not postage costs etc? Will be gutted to lose all these weeks before I sent in new evidence 😭

I don’t know I will be calling them on Monday to find out, you don’t get postage back anyway so I don’t see why it would be postage, when I called them they said because it’s like new evidence that they don’t know about they are trying to say the decision might have been different if they had new evidence, all my evidence does is clarify the old evidence, I wouldn’t class it as new but it is in fact new to them isn’t it :/
very stupid, if they read all my form in the first place he should of been rewarded it anyway. The reasoning to why they didn’t award it aren’t even in my form so none of it makes sense. I just asked specialist and school to clarify the old evidence that’s literally all iv done it’s pathetic how someone doing that kind of job don’t even do their jobs probably because they cba. Get a job that doesn’t actually ruin peoples lives, (when declining) our children go without enough plus feeling invisible as it is without them declining our children of more support that they obviously need.

Lou84lou · 11/02/2024 15:31

When I asked for a mandatory reconsideration they told me that I have a specific date to get more evidence in , they also told me that it would be back dated to the original date regardless of what further evidence I sent in

Jneill2021 · 11/02/2024 15:38

I've just been awarded for my son after Mr he was on lrm they changed there mind to hrm and the difference was backdated to the original claim last May and I sent 80 pages of new evidence for mr x

jellycat12 · 11/02/2024 17:47

Keeping everything crossed then as they have given me my deadline date but I was told the new evidence list the back date but you've give. Me some hope as it's been nearly 25 weeks x

Homesweethome93 · 11/02/2024 18:36

That’s brilliant news, no idea why it says that on the forms then if you do get backdated x

Sarahdestiny · 11/02/2024 20:23

That's fantastic news. Did you receive a call or text to tell you?

Jneill2021 · 11/02/2024 20:55

@4girlswithatwinkle no I just called for an update decision was made 2 days before I called xx

Mumzieof1 · 11/02/2024 22:36

I will keep you updated I'm going to ring first thing, I received one letter dated 2nd Feb saying MR taking 11 weeks then one dated 4th Feb saying taking 15 weeks. Need clarity tomorrow on how long and if my evidence will still let me keep backpack from June 2023 when rang for forms. What a long process!

82cem · 11/02/2024 22:47

I spoke to a guy nearly 2 weeks ago, he told me they were taking 7 weeks(i rang 30th Jan and told me I should hear by the end of that week) I'm 9 weeks tomorrow and not heard anything as of yet. Hopefully soon, I got a decline Initially but I sent more school plans, reports and immediate family statements too so really hoping the decision is over turned.

Mumzieof1 · 12/02/2024 09:47

Morning, I've just come of the phone to a lovely lady, she said it's still a mandatory reconsideration not a new claim. She said they get passed to a new DM after 7 weeks, even though I was 7 week last week, she said then they will go through every bit of evidence I'd sent so could then take about 3 weeks before decision is made, so it'll be about 11 weeks hence the letter I received. The 15 week one after that was a generic letter sent out for new claims but she said ignore it.

Fingers crossed for you, seem to be taking a little longer at the min, mine 8 weeks this week and not even with a DM yet. She said should be picked up this week then a decision about 3 weeks as the 'thoroughly go through the evidence' let's hope! With the MR I sent the latest rheumatology report and a copy of her access card, then last week I sent her pupil profile from school as just placed on SEND register and a statement from my step mum. So hoping them last 2 make a difference.

Anyone else finding these MRS mind blowing messing it is with my head stressing especially All effort & time that needs to go into 1 i cant think of anything else is on my mind constantly keeping me awake at night ..most probably ends up with a decline to :/ also finding it hard to get evidance supporting my form as quickly as possible as everytime I'm asking either get ignored or say yes and then they do nothing about it so frustrating :/ can't wait until its all over honestly

Yep. I tried calling this morning but was cut off after 32 minutes.
I spoke with them last week when they called me but dying to know the outcome

4girlswithatwinkle · 12/02/2024 17:08

Called again and they made the decision last week and it's a decline again 😭

jellycat12 · 12/02/2024 17:18

@4girlswithatwinkle I'm so sorry it's breaking 😔

I rang today only just starting MR haven't even received decision letter yet but I got a lovely guy who read the whole letter out to me we were declined due to lack of evidence and that my sons needs are no different to any other 10 year old boy 😔 he's 11 know and I wish he was easy some days 😞 ( my form wasn't filled out the best I'll be honest could supply a lot more detail at the time but sleep deprivation really dose take over I asked if I was better off doing a new claim and filling it better and he said go for the mr there taking 7 weeks and supply a letter and as much evidence but I'm just not holding out hope my dead line is the 22nd of Feb 🤦🏼‍♀️

Thank you!! Gutted tbh but I'm not very good at filling in forms.

Lots of mr get overturned so don't give up now!! Take it all the way because your son deserves it.

They don't have a clue about what the kids need as they've said the same about my thirteen year old daughter, and I can assure you the things she does and neede help with I don't have to do with her younger sisters who have asd themselves

jellycat12 · 12/02/2024 17:52

It is so difficult.

I'm currently photocopy the screening packs that were sent to camhs last year home/ school ones his shared cared agreement with gp and paediatrician confirmation that were on waiting list for family support worker letters from camhs unsure if to even send letter from 2017/18 when he had oral difficulties and all previous rejection letters from camhs? To show how long this has been going on for?
