DLA Mandatory Reconsideration 2023

Hi, I’ve been following the DLA wait times thread since I applied for my 7 year old son in October. We had the decision yesterday and it was declined 😭 I was absolutely devastated.

We applied because my son was involved in a serious RTC (we were going on holiday with our friends, he wanted to travel in their car following us, a car came round a bend missed us but hit them head on) understandably he struggles with the fact he was the only one in the car and blames us for letting him in there). He was the only one awake and conscious in the vehicle, he has chronic flashbacks, normal everyday life things (sirens, bangs, travelling, weather conditions and so on are triggers) they send him into a state of survival and all his rational thinking is gone. Nights are horrendous for him, he lives like his life is in constant threat, he fights sleep and often gets dressed in the middle of the night so he’s ready should anything bad happen. Flashbacks are more prominent through the night.

school are aware of his issues. Now he’s under CAMHS school have been asked to stop any mental health interventions as this could interrupt the trauma therapy. hes happy at school because of the structure and routine, no real unpredictability etc.

anyway I’ve done this tread for anyone going through MR and hope we can all support each other through the process!

xxx

How long have you been waiting?

82cem · 07/02/2024 20:01

I was 8 weeks on Monday but I'm guessing it's still 7 weeks to them if they're not counting Christmas, fingers crossed I'll have an answer in the next dew days.x

4girlswithatwinkle · 07/02/2024 20:29

I sent the mr forms back on the 19th December

Dla96 · 07/02/2024 22:16

It’s taking 10 weeks for a MR now the women on phone told me it goes to a case manager on the 8 week but mostly takes another 2 weeks for them to make a decision

4girlswithatwinkle · 08/02/2024 11:38

Had another call from dwp this morning just asking me a few questions. Hope they accept this time

Hi jumping on,

My sons dla was refused the 22nd of Jan 24 due to page 8 not being completed my own fault I miss read it and a few other bits have been missed on the form 🤦🏼‍♀️ anyways family are pushing me to do mr and write in the letter what I should have put on page 8 and supple the evidence that there involved, do you think there's any point or should I re do the form and start again? Thanks 🙏🏻

jellycat12 · 09/02/2024 14:04

Definitely try again, put as much detail down and remember to go on the worst day you’ve had with him, go into the very little detail if you need any help I’m happy to help xx

Does anyone know why they tell people different lengths of time? One says 8 weeks and today they said 16 weeks , i
so confused. I’m week 7 now for a MR after being turned down first time. I sent a lot more evidence this time.

No idea to be honest. I feel like they just say what they feel like tbh.
I waited ages for them to decline our application initially, to read on here people getting claims looked at from a month or more after. Really should be a set order as it's so stressful waiting so long

jellycat12 · 09/02/2024 20:03

@Homesweethome93 Thankyou so much just worried as I photocopied it and had a look and didn't fill in page 8 or get senco to do page 10-11 ( was summer holidays) so just worried mr will be a waste of time as waited 21 weeks to be refused and know it can be that again just for mr xx

Apparently it is harder to get it mr I’m trying right now my little one gets high rate care low rate mobility but I’m trying for high rate mobility, but you could try that and then if it gets declined again then do it again, you could right a letter with the form and just put that you didnt fill that it, you won’t get the back pay if you send new evidence in only to the day they receive the MR, send every bit of evidence in that you have, try not out any positives in, if there is any be like, although he does this or that, he does this while doing that kinda thing, xx

jellycat12 · 09/02/2024 20:49

@Homesweethome93 yeah it looks like it, and ooh 🤞🏻 for you and it gets accepted... and yeah we hen I rang they said if I supply new evidence it won't get back date gutting if I'm honest as it would definitely help out with him moving to secondary school in September... just so worried the mr will be a waste of time and only have till the 22nd of Feb but still awaiting the letter the first one got lost in the post so they said there resend but still nothing xx

My friend was waiting 5 weeks for the letter, it’s pathetic really, I’d ring up and ask them over the phone for the reasons word for word and write it down, you can print the form off and fill it in and send it off, I haven’t waited for the letter, half of the advisers don’t even note anything down, and if you do it over the phone tell them your sending extra evidence in aswell, as I have heard they don’t really listen to what you want them to put. It’s just a job for them, it’s our lives for us and our kids. Xx fight for what you know you are entitled too, don’t settle for any less. We are our children’s voices.

jellycat12 · 09/02/2024 22:35

@Homesweethome93 it really is I only rang the first time as had seen people with a later scan date be awarded and that's when they said it had been refused and letter was sent 22nd of Jan rang again 2nd of Feb and was told to wait rang again 6th of Feb and said I still hadn't got it and was told they would resend it... asked for refused reason and just say his asthma is under control by gp and that page 8 wasn't completed and I had stated he had adhd and asd but no one was involved as didn't complete page 8 ( had a look though and I didn't my own fault) I can supply the evidence that he is under chams and school senco involved by unsure if should just start again and fill in correctly and supply all the evidence last time I just sent is diagnostic letter I do get it's my fault for not completing form properly but so conflicted on what to do also dosent help I'm sleep deprived both my boys don't sleep 😴 xx

That's the first time I've heard that about not getting back pay if you send extra evidence? I've done a MR and sent new evidence with it then rang again and told them I have more evidence as she'd just been put on SEND register in school, they told me to send it and she'll put a note on the system to wait for it. Oooh I'm worried now as I rang up for the forms in June, they received my MR 21st December and I got a letter this week saying MR taking 11 weeks. So by the time they decide it'll have been a long 36 week process! Draining x

jellycat12 · 10/02/2024 09:16

@Mumzieof1 I was told on the phone on 6th of Feb that any new evidence wipes the back pay and then if accepted it's back dated to date of new evidence gutting if I'm honest x

Oh my word, that's sickening! I'll try fight it as they never told me that. As if the wait in itself isn't bad enough. Thanks for letting me know. X

Oh does it! Oh no, so is this after the mandatory reconsideration if you send anything in once you've done that? I might ring them to say to dispose of the 2 new pieces I've sent last week. X

jellycat12 · 10/02/2024 11:11

@Mumzieof1 from what I've read it's a general even if you send new evidence to support you claim form your awaiting a decision on x

Nothing about not getting it backdated to the start of your claim is mentioned on Google or citizens advice if you appeal.
