DLA Mandatory Reconsideration 2023

Hi, I’ve been following the DLA wait times thread since I applied for my 7 year old son in October. We had the decision yesterday and it was declined 😭 I was absolutely devastated.

We applied because my son was involved in a serious RTC (we were going on holiday with our friends, he wanted to travel in their car following us, a car came round a bend missed us but hit them head on) understandably he struggles with the fact he was the only one in the car and blames us for letting him in there). He was the only one awake and conscious in the vehicle, he has chronic flashbacks, normal everyday life things (sirens, bangs, travelling, weather conditions and so on are triggers) they send him into a state of survival and all his rational thinking is gone. Nights are horrendous for him, he lives like his life is in constant threat, he fights sleep and often gets dressed in the middle of the night so he’s ready should anything bad happen. Flashbacks are more prominent through the night.

school are aware of his issues. Now he’s under CAMHS school have been asked to stop any mental health interventions as this could interrupt the trauma therapy. hes happy at school because of the structure and routine, no real unpredictability etc.

anyway I’ve done this tread for anyone going through MR and hope we can all support each other through the process!

xxx

Anyone had any updates today?

Mumzieof1 · 02/02/2024 11:00

I rang up for forms 29/97/23, scan date was 14/7/23, waited over 18 weeks for it to be declined. Done a MR which they received 21/12/23 and haven't heard a thing since. Rang today as my daughters teacher has out her on the SEND register and she now has a pupil profile (that was one of the reasons I was declined, no support at school) so obviously I rang them today to say I'll send pupil profile when I receive it on Monday, the lady said that was fine as MR are taking longer than usual, about 7 weeks before picked up by a DM, my 7 weeks is next week so they'll have it for then and she's put a note on the system. I then receives this text message and I'm wondering why as I've had no other correspondence since putting in my MR, so that'll be another 4 weeks on tol of the 7 ? Anyone had this ?

@Keddie I just called decision made Wednesday they have changed it from lrm to hrm till 2030 I honestly can't believe it it will make such a big difference in my boys life xx

Dla96 · 02/02/2024 13:27

That’s good new I’m still waiting done my 1 week before you @Jneill2021 did you send a lot of evidence in for the MR?

Jneill2021 · 02/02/2024 13:32

Yeah I think it was about 80 pages of evidence to be honest plus supporting letter from sister who works within childcare and a supporting letter from senco at my sons school x have you called them ? X @Dla96

Dla96 · 02/02/2024 13:34

I’m only doing the MR for mobility from lrm to hrm, so I sent in more evidence for that, not sure how much evidence they need for the mobility part but, I rang today said couldn’t tell me over phone. Strange considering I’ve seen a few on here now been told over phone lol

Jneill2021 · 02/02/2024 13:42

@Dla96 I just called earlier and said can I have an update on my sons Mr as been over 8 weeks and she was really nice and said yes that's fine x

Dla96 · 02/02/2024 13:54

I normally do the live chat I don’t know if that’s better then phoning but I’ve phoned to, I’ve done the mobility under vuw and smi with evidence from all the specialist so I will just need to wait and see @Jneill2021

Jneill2021 · 02/02/2024 13:58

@Dla96 as far as I no they don't do an online thing you have to ring 08001214600

Dla96 · 02/02/2024 14:11

So who’s the live chat that I contact? Maybe I’m different from u cause I’m in Scotland

Just an update - MR submitted 15th November and had a call today from a lovely lady who asked a couple of questions then decided to award HRM until my sons 12th bday (8years) I cried I was so shocked. Good luck to everyone waiting and thank you all for keeping me sane over the last few weeks ❤️

Jneill2021 · 02/02/2024 16:16

@Keddie thank you xx @Anonymous1993x amazing news congratulations xx

82cem · 02/02/2024 20:13

I'll be 8 weeks on Monday from what I've worked out, am I looking at another week, as they'll class ot as 7 weeks won't they from what I've been reading? I really hope the decision is over turned with the MR.x

Nicole313 · 03/02/2024 22:28

Hi congrats to all that has been awarded I was declined in November and recieved the statement of reasons which seemed as if they didn't look at my evidence put in mr and I am 7 and half weeks I got a call today asking some questions and he then said he's awarding my daughter hrc and lrm and backdating till May 2023 I'm over the moon for her and so glad I did mr as I wasn't going to bother

Good luck to those waiting

Katey252 · 03/02/2024 23:23

Hi - Just wondering I have just been awarded HRC but kept on LM on a change of circumstance (awarded this week after waiting 18 weeks) - but now my daughter has been awarded the HRC she would come under all the other criteria for Severe mental impairment for HM - can I ask them to just reconsider the Mobility section of it ?

Jneill2021 · 04/02/2024 07:12

@Katey252 ring and ask for a statement of reasons then if you feel like she should still be awarded hrm do a Mr and state your challenging the mobility part. I done this after alot of wondering weather its worth it and it really was as they changed there decision and awarded hrm, if you feel that strongly defiantly go for it xx

Lou84lou · 04/02/2024 15:29

So it’s roughly 8 weeks for a mandatory reconsideration?

Jneill2021 · 04/02/2024 15:42

@Lou84lou yes mine was 8 weeks Thursday and was awarded Wednesday x

Dla96 · 07/02/2024 16:21

Anyone heard anything this week so far?

4girlswithatwinkle · 07/02/2024 18:36

I've had a missed call today from dwp but then received a text later on to say I'd have a decision in 4 weeks
