DLA Mandatory Reconsideration 2023

Hi, I’ve been following the DLA wait times thread since I applied for my 7 year old son in October. We had the decision yesterday and it was declined 😭 I was absolutely devastated.

We applied because my son was involved in a serious RTC (we were going on holiday with our friends, he wanted to travel in their car following us, a car came round a bend missed us but hit them head on) understandably he struggles with the fact he was the only one in the car and blames us for letting him in there). He was the only one awake and conscious in the vehicle, he has chronic flashbacks, normal everyday life things (sirens, bangs, travelling, weather conditions and so on are triggers) they send him into a state of survival and all his rational thinking is gone. Nights are horrendous for him, he lives like his life is in constant threat, he fights sleep and often gets dressed in the middle of the night so he’s ready should anything bad happen. Flashbacks are more prominent through the night.

school are aware of his issues. Now he’s under CAMHS school have been asked to stop any mental health interventions as this could interrupt the trauma therapy. hes happy at school because of the structure and routine, no real unpredictability etc.

anyway I’ve done this tread for anyone going through MR and hope we can all support each other through the process!

xxx

Mojo161989 · 30/01/2024 13:48

They are saying its with a case manager now, does anyone know how long this usually takes, and is there a difference between a case manager and a decision maker? Xox

Anonymous1993x · 30/01/2024 13:48

Mine has been with case manager/decision maker for over 2 weeks now xx

Hey keddie , How was you told what you was awarded I thought they was not allowed to tell you, u have to wait for letter been posted out?

They told me over the phone when i called back to ask

Dla96 · 30/01/2024 14:28

@Keddie ahh right weird because I asked on phone about my and they said you’ll get the letter next week wouldn’t tell me the outcome.

Keddie · 30/01/2024 14:29

@Dla96 loads of people on here call up for rates you clearly got a grump

Dla96 · 30/01/2024 14:58

She just told me everything is on the form and that’s the reason they send it out

Keddie · 30/01/2024 15:10

@Dla96 so you could call back and hope for someone nicer or wait for the letter ?

Dla96 · 30/01/2024 16:11

@Keddie you must of just got lucky lol, cause apparently they don’t tell you over the phone under any circumstances called up and asked again I’ll just have to wait for the letter 7-8 working days they said lol

Keddie · 30/01/2024 16:14

@Dla96 thats mad loads of people have called up, I have seen some today? Hopefully you will get the money before the letter and can figure out your rates?

Dla96 · 30/01/2024 16:20

its only the mobility I’m challenging from lrm to hrm my LO already gets hrc, guess I’ll just need to wait and see thanks anyway keddi

Keddie · 30/01/2024 16:22

Hey @Dla96 if you follow this you will see some have been updated over the phone too. Maybe they told me because I had a full decline hence MR not to increase? No idea just guessing but fingers crossed not long for your letter now DLA Wait Times - Part 27

Dla96 · 30/01/2024 16:35

Normally when they don’t tell you anything it’s bad news don’t know what waiting times are

Anonymous1993x · 30/01/2024 17:40

I was told over the phone when COC was unsuccessful for HRM but this wait for the MR is killing me 😭

Dla96 · 31/01/2024 06:25

Yeah I was told over phone first time what I’d been giving but I think it’s different for the MR, are you going for hrm under smi or vuw @Anonymous1993x

Homesweethome93 · 31/01/2024 08:10

Hello I already get high rate care low rate mobility for my son, asked for mr for hrm instead of low rate as I believe and professionals do too that he entitled to it, filling in form in asked professionals to clarify my sons needs (different words to original letters) is this classed as new evidence as I already put everything in the dla form, it’s just a different way of wording it ? They say if you have new evidence you don’t get back pay? I applied for this in August it’s a lot of money for them not to back pay over wording of a letter ?

also I’ve added a virtually unable to walk test as I thought you could only go for either smi or vuw not both together, the grounds they have declined my son don’t even make sense they are nothing to do with smi, I have now got a letter that saying my son has a intellectual impairment and he has no danger / stranger awareness.

any advice welcome 😫🤨😩😊

Dla96 · 31/01/2024 09:44

From what I’ve been told and heard it’s hard to get hrm, even if you meet the criteria of what it states on their website they still find a way to not give u it. It’s just unfair and they don’t seem to take all the evidence u send in accountable.

Anonymous1993x · 31/01/2024 09:54

SMI xx

Dla96 · 31/01/2024 10:20

That’s the section I have went under also. I’m just waiting for my letter with the outcome said it could take 5-7 days

Mojo161989 · 31/01/2024 10:34

Ive also applies under SMI and VUW, have feeling it will be declined, so getting ready for a tribunal. He also got rewarded MRC when he clearly meets the criteria for HRC, so waiting for that too, it's awful waiting and having to fight and go over and over things again with them just to get what our children deserve. Hope we all get good news soon xox

Dla96 · 31/01/2024 11:03

Yeah you’re right, I’m prepared for tribunal also, but I’m also intruded to what they can/ will knock me back for as I’ve got evidence from every specialist that works with my LO, here’s hoping we all get good news but, how long you been waiting @Mojo161989

Mojo161989 · 31/01/2024 12:40

@Dla96 I've been waiting 10 weeks today for the MR was with a case manager yesterday, so hoping it won't be much longer. Fingers crossed that it's good news for you 🤞. Hopefully all the evidence you've sent will be enough, I know I don't quite understand why they argue it, when it's clear they meet the criteria, seems alot of people go to tribunal and then its turned around and awarded, but I don't see why it should have to come to that. Xox

Dla96 · 31/01/2024 12:55

You’ve been waiting 2 weeks longer than me the time frames are so long and draining, hopefully you get good news also as you’re fighting for the same as me. Shouldn’t need to come to this but unfortunately it does. Yeah I’ve also heard most people that don’t get it, end up getting it at a tribunal the waiting times for one of them are up to 1 year but so it will be a lot of waiting if need to go down that root.

Mojo161989 · 31/01/2024 15:20

Omg I've just had a call from the dla and been awarded HRC and HRM for my little boy, im so happy and until he is 12. It's such a relief. That was from MRC and LRM. Thank you all for your support and fingers crossed to all still waiting. Took 10 weeks in total xox
