DLA Mandatory Reconsideration 2023

Hi, I’ve been following the DLA wait times thread since I applied for my 7 year old son in October. We had the decision yesterday and it was declined 😭 I was absolutely devastated.

We applied because my son was involved in a serious RTC (we were going on holiday with our friends, he wanted to travel in their car following us, a car came round a bend missed us but hit them head on) understandably he struggles with the fact he was the only one in the car and blames us for letting him in there). He was the only one awake and conscious in the vehicle, he has chronic flashbacks, normal everyday life things (sirens, bangs, travelling, weather conditions and so on are triggers) they send him into a state of survival and all his rational thinking is gone. Nights are horrendous for him, he lives like his life is in constant threat, he fights sleep and often gets dressed in the middle of the night so he’s ready should anything bad happen. Flashbacks are more prominent through the night.

school are aware of his issues. Now he’s under CAMHS school have been asked to stop any mental health interventions as this could interrupt the trauma therapy. hes happy at school because of the structure and routine, no real unpredictability etc.

anyway I’ve done this tread for anyone going through MR and hope we can all support each other through the process!

xxx

Also do DLA call off withheld numbers? I have missed some calls this week but could not answer due to work?

ARH36 · 10/12/2023 19:40

I think they do, I’m not 100% sure.

Mojo161989 · 10/12/2023 20:22

Mojo161989 · 11/12/2023 11:25

@Keddie spoke to them this morning and they still haven't received evidence I sent recorded over two weeks ago, may not even look at it before it goes to a DM at this rate. But they said around 3-4 weeks to be looked at again. Xox

Keddie · 11/12/2023 11:43

@Mojo161989 I just called in too, all they could say is that it is waiting to be looked at and a decision would be made within the next 3 weeks xx

Girlmum3110 · 11/12/2023 12:30

Good news on the claim @Mummymummy22

They received my daughters MR on the 16/11. Hoping it’s not too much longer to get looked at.

ARH36 · 11/12/2023 13:34

Girlmum3110 · 11/12/2023 14:34

Rebeccachloe · 11/12/2023 15:26

Bettyboo73 · 11/12/2023 18:29

Im awaiting a MR my son has multiple complex needs in a special needs school with a 6 staff to 10 student ratio. His EHCP stated he was a good walker and transitions well within school their reason for refusal of HRM. Although they have not taken into consideration any of the other things on his EHCP or in the medical reports submitted in relation to him having Epilepsy/ severe tiredness/ failure to thrive/ kidney issues/ global development delay/ splints as he has over pronunciation both feet / bone movement / hypertonia throughout his body/ unsafe gait / high pain thread hold / is unsteady on flat surfaces / uses a special needs buggy out of home and that an EHCP is completed by a teacher based on education they can not alter my sons walking issues or how cognative levels and refusals interventions are a normal part of life for him and his peers and they manage his transitions his class is for students with complex communication issues and autism. My son has a rare genetic condition and although has autistic traits his genetic diagnosis is considered the reasons for his complexities both physically, medically and cognatively. My son has no understanding of the world around him he is preverbal does not understand verbal, picture or objects of reference. He is destructive he kicks nips scratches he refuses he lays on the floor and goes limp these are daily occurrence and he is at that point 2:1. He has school transport and can not sit next to anyone or with anyone in front of him as he will scratch nip and pull hair. He wears a 5 point harness as he does not understand he has to stay seated and will slide under the belt and escape if not in it which has led to the bus having to stop for the safety of all on board.

im beyond seething that they have cherry picked one comment and don’t have the intelligence to read these document properly and consider the purpose of these and why it may say transitions well objectively as in considering where he is and that it is expected that interventions take place.

I have submitted the MR school have done 2 letters explaining my sons traditions and his medical issues, his Peadiatrician has also done a letter explaining he is virtually unable to work and SMI and that she supports my claim HRM and will provide any other evidence they require to prove this and his Disability Social Worker has also provided a supporting letter. I have also contacted our local MP complaining that this document has been taken out of context and they have Cherry picked from it. They have also contacted them to ask them to look at his case again.

I hope this does not go to tribunal but if it does I’m going face to face! I need to know why and what they classify as disabled for HRM because I’m sure as hell my son qualifies.

Bettyboo73 · 11/12/2023 18:53

MR

ARH36 · 11/12/2023 19:26

@Girlmum3110 no timeframe as such but said it was “in holding” and should be with a case manager soon (I have no idea what the difference is between case manager and decision maker is) , and I should hear something this side of Christmas

Girlmum3110 · 11/12/2023 20:27

@ARH36 from what I can gather from the other DLA feed and this one, a case manager is level above a decision maker. Well let’s hope so, been going on since June for me x
