My child father has refused to give back my 14 month old girl. She is breastfeeding at night and I’m massively concerned.

You need to download a C100 form - and tick the box that says emergency - take that to your local court tomorrow and pay the fee (unless you are exempt) which would require you to fill out another form EX160 (I believe) - think it was this form when I had to do it.

They will tell you there and then if they can schedule an emergency hearing.

You do not need a solicitor to do this - but you can also call a solicitor and they usually give you half hour free.
Either way; good luck op - hope things happen quickly and your daughter is back with you soon.

I didn’t see that. Of course I agree with him if that’s the case.

Obviously in my home that would never be the case - hence no one being able to stop me for anything.

Seek advice from a family solicitor and ask for a specific issue order. If he's not on the birth certificate, then just to take the child back.

Help with Court Fees

I would fill in both tonight and take them to your local County Court at 9am. If you fill in the form online I'm not sure it will even be considered until after the New Year.

Rights of Women have sone useful guides and they're free.

I think this poster is suspicious as to why she hasn’t gone round. Getting arrested would not be a deterrent for me.

He's her father and deserves overnight access too - given he's concerned you're bringing someone dangerous around your child, if he's sensible he'll have already applied to the courts.
