Stepdaughter and Inheritance.

DH has 2 previous children from ex wife, i have my own ds and we share a child together. my husband bought our house, put in his own deposit and his name only on mortgage as i had bad credit and currently in a debt management plan trying to get debt free.
i do pay towards house household and bills etc
topic came up if were to pass away before me, he said the house would be paid off and could remain living there. but when and if house was sold his assets and property would be split 4 ways 25% each to his 2 dc our child and me. nothing to my own child who is his stepdaughter. what are people’s thoughts on this ? i feel i suppose its fair as its all his money and not mine.
i will one day inherit from my parents and i would split that between my own 2 children so i suppose its fair. my step children will also inherit a large amount from their own mother. ak

IMO the split is with all 4 children, and any inheritance you are fortunate to receive gets split between the 4 as well.

how old are the children? I’d be more concerned about your own living arrangements if something did happen to DH if you only have 1/4 interest in the property.

How old are you? How old is your dd/DH's stepchild? Are you working or a SAHM?

You and DH have put you in a very precarious situation because he could change his will at any time.

I would speak to a lawyer to understand what your rights are.

On the specific point about inheritance, I think your HD is not obligated to leave your dd a share in the priority but I think you have much bigger issues at the moment.

Your joint child will inherit from their biological parents.

And your daughter will inherit from her biological parent.

You don't mention you leaving anything to your 2 step children.

No inheritance should be counted on.
Care home fees etc.

You admit the inheritance from your parents will go to your bio kids and not your stepchildren so why are you asking?

Has he got a will that says that? As if not it will pass to his wife before his children so you can cut out or add any kids you like.

All sounds ok to me.

The person in this scenario who is vulnerable is you- your husband could change his will at any time, potentially leaving you homeless (you might have a claim as dependent spouse but would need to go to court). When you come to remortgage it would be worth seeing whether you could be added to the deeds and mortgage (despite the debt)- a mortgage broker should be able to advise you.

I would say that’s fair. But I’m not on the side of idolising SC to ensure they get everything which a lot of mumsnet seem to be.
I’m in a similar situation in terms of SC, shared child etc. But we’re both on the mortgage. We have 6 children between us so we’ve done it so that my half goes to my bio 3 and his half goes to his bio 3 (one of whom is mine). However it was solely my deposit, and I’ve protected that so that only goes to my 4 children. Which won’t amount to too much anyway.
Has he got this in a will then? As others have said I presume it will go to you anyway if you’re married and he hasn’t got a will tha specifically says this. But either way if you’re not happy, you could always give your 25% to your child.

Whatever you decide, sort it now, be clear with everyone what will happen and have an open discussion (assuming they’re old enough). Just get ahead or it could turn ugly.

I’m of the opinion that people should leave their half to their children, not their spouse. Many a fool has inadvertently disinherited their children.

Say you die and everything goes to your spouse, your spouse remarries, your spouse dies, everything goes to the new spouse, your kids get shit all. Happens all the time.

If I die, then everything goes to DH, and vice versa. Its only when the last one dies, does the money (if there is anything left) go to children.

But op has already said she wont be leaving her dsc anything so it comes across to me as a very hypocritical post.

If it bothers you ask your husband to leave your 25% to your daughter and not you.

I believe it may now be able to put house ownership in joint names.
I bought our house before marrying and it was in my name but after many years of marriage (mortgage paid off) I realised if I died sooner than my spouse it could lead to difficulty over probate etc so corrected the ownership to joint.

Sounds reasonable. He is leaving a portion to his children so you cant become a wicked stepmother and run off with it! Your existing children will inherit from you. You presumably wont leave your stepchildren anything? It would be more usual dor him to divide it 3 ways though.

Provided you get a life interest (with caveats like any remarriage) he's making a sensible choice. He knows you're in debt, it might happen again in the future, so he's protecting all his children from your debts.

I think he is being more than generous. I am not sure I would have made that division of assets in his place. I think once you are on your second marriage with kids from previous ones, the children should be inheriting. It would be entirely different if you had also come into the marriage with assets.

Why are you questioning whether he should include your child (his step child) in his will when you do not intend including his in yours???
