Stepdaughter and Inheritance.

DH has 2 previous children from ex wife, i have my own ds and we share a child together. my husband bought our house, put in his own deposit and his name only on mortgage as i had bad credit and currently in a debt management plan trying to get debt free.
i do pay towards house household and bills etc
topic came up if were to pass away before me, he said the house would be paid off and could remain living there. but when and if house was sold his assets and property would be split 4 ways 25% each to his 2 dc our child and me. nothing to my own child who is his stepdaughter. what are people’s thoughts on this ? i feel i suppose its fair as its all his money and not mine.
i will one day inherit from my parents and i would split that between my own 2 children so i suppose its fair. my step children will also inherit a large amount from their own mother. ak

So you are not content that this man has bought you a house outright and said that you can remain there until you die?

Instead you want him to give your daughter who is also benefiting from his generosity a share too upon his death?

In that case I assume you will give hos daughters a share of your assets etc?

Yes, it seems fair. Everyone inherits from their parents. Your percentage of the house you can then split between both your children. Obviously, your two children would have been better off if you didn’t have debt issues and you had more equity of your own built up, but I don’t think that is anyone else’s problem to fix. You presumably still have many years to get yourself into a better financial situation so that you can leave more to your children.

I don’t expect to inherit anything from my stepfather. I think I am technically in his will, but only to spite his own biological children because he hates them more than he hates me. I personally think it’s shitty.

I think it ´s fair , you could always give your share to your daughter. I’d be more worried about not having anything in my name now. Inheritance you may come into or not.. I wouldn’t count on it too much.

He’s guaranteed you a home until you die no matter when it happens, your daughter is significantly benefiting from that as well, you are perfectly capable of passing on your 25% to her.

what are you doing to provide for you husband and step children?

My stepdad is wonderful, paid for school, university, house deposit, wedding, cars, treats me and my husband and child wonderfully, no pressure from my mum, but I do not expect a penny from him when he dies. He and my mum share a child and I fully anticipate it all to go to her/wherever he wants. You can’t control what he wants to do, his money etc. nobody is entitled/guaranteed to inheritance!

thanks for all your comments. ive never been married not owned a house before so i wanted others opinions
i was in rented accommodation when i met my husband and for reasons i wont go into i had debt put into my name that was not mine but i was in a very vulnerable situation at the time. unfortunately as it was in my name i was responsible for it. i dont expect my husband to give to his stepdaughter as she is not his child. i wanted to see if anyone else had been in my similar situation before.

Why should he put your child in his will?

If roles were reversed and he was the one in debt and you had purchased the house he was living in, would you be putting his child(ren) in your will?

I think all children and step children should get equal shares. My parents divorced. When DD and step mum died they left most of assets to her/their children. DB and I got far less. I’ve always resented it. When DM and step dad dies they split everything equally between all DC and step DC. They did this because they saw all their assets as the joint assets of a married couple, despite the fact my step dad earned way more.

Even if things are left exactly and you describe, and that’s a big if, you could leave your 25% entirely to your daughter if you wanted to even it up.

A stepchild usually has to wait for their parent to inherit, then their parent leaves them money/property. I have never heard of stepchildren being treated the same as full children ,if they are not adopted

The op isn’t planning to share any inheritance she gets from her parents with her step children. Why should the op expect her husband to treat all children equally when she has no intention of doing the same?

Even if in his name it is marital property so surely you should get half. He can leave his own half between his 3 children with a direction that they only get their share when you move or if you remain in the house he could give a specified time frame or upon your death.

So where is the issue or why is this even a question? You say you will inherit and leave to your two children (he is also saying he will leave his assets to his children) and you say you don’t expect him to leave anything for your daughter. So why do you need to know what we think?

It sounds fair enough but leaves you in a very vulnerable place. In the future if you were elderly and some of his kids want to sell you would end up with nowhere and only a quarter of the house.

the house should be changed now so it’s in both of your names. I live with my DP it’s our house we both own it. I’d not have agreed to anything else.

You need to get a legal agreement that you can stay in house should anything happen to him.
It’s very common and relatively cheap to do.

It is fair. Your daughter will receive less than her half and step siblings because her parents do not have the same financial resources. It is not your husband’s responsibility to compensate her for this.

And your daughter will inherit from her biological parent.

You don't mention you leaving anything to your 2 step children.

Or no one will inherit from anyone? Why do people always assume they are going to inherit anything?

yes, im not sure if its the"family home" and the couple are married with dependants - how the ops dh can only leave 25% of the house to his wife?

if the ops dh dropped dead tomorrow, where would the family live?

How much do you contribute to the house? What % is covered by you and what by him? What % Of childcare of your joint daughter do you do?

I think that is fair.

All of our assets are merged so on our death our estate will be split 2/3 to my daughter and 1/3 to my stepdaughter. However, some of the inheritance I get from my parents might be ring-fenced for my daughter.

Assuming you're in England, he would need to leave you at least as much as you would get in a divorce (which is likely more than 50% of your joint assets as you have two children to bring up). If he doesn't you can challenge the will and would almost certainly be successful.

I don't think he's morally obliged to leave his step DC anything like what he leaves his own DC as a general rule, but if he's develops a true fatherly relationship with step DC for many years and he's leaving money to all his other children, I think it could be quite nasty of him to leave them out completely. It wouldn't be unreasonable, though, to leave some money to your step DC and the rest to you to bring up your children with and distribute to them on your death.
