Using mobile phone when driving

Hoping I can get some advice. I received letter this morning asking me to confirm if I was driver earlier this week on set road at set time as I had apparently been using my mobile phone.

It was definitely me driving and I was on phone at that time- checked records and I was on a works teams call. However, my phone set up is blue tooth to come through car, and as it was a phone call I can’t see why I would have been touching my phone at all (it sits in the central bit of car). I don’t play with phone in car, but even still I have double-checked messages etc and as I expected there is nothing sent. Am a bit confused- unless I literally moved the phone, but even the am not sure why I would.

The letter doesn’t give other details or say what the evidence is. I don’t want to dispute if it’s true, but I also don’t want to say I am guilty without checking it.

has anyone been in this situation? Do they send the photo or evidence after you confirm you are driver?

Posting in AIBU for traffic. Fully appreciate if using phone while driving then it is unreaonable behaviour and so makes sense to get the fine, but this is not what I am disputing! Thanks in advance.

  1. Driving is the one thing most of us do that is safety critical and we run a rick of causing death/injury/damage to ourselves and others when doing it
  2. There are some things that the law says you must NOT do when driving eg use a hand held phone or be intoxicated
  3. While there are a lot of things that are not specifically illegal eg using a hands free phone or consuming alcohol BUT which raise the likelihood of becoming involved in a Road Traffic Collision
  4. The OP has admitted to being on a work Teams meeting using her hands free while driving something that the science suggests raises the risk of a RTC
  5. Points 1 to 4 are factual unless anyone would like to dispute them.
  6. I would suggest given the FACTS about the additional risk associated with using a phone even hands free when driving AND that a lot of the people on this thread - I assume are in jobs which require skill and judgement taking a phone call when driving suggests a lack of judgement incompatible with their current job even if its legal

Using upper case letters makes your point no more valid!

Using a hands free mobile, to take and receive calls remains legal, your view does not make it law.

It baffles me that people always use this as a comparison - it’s completely different! The passenger can see what you see and is aware of your surroundings - the person on the other end of the phone is totally oblivious to this.

As an employer I oay my employees to work and give their attention to the job at hand. Driving a car, doing messages and ferrying kids about is NOT working .

Its legal to do 60 mph on a lot of single track roads with passing places as well

This particular one is not a problem, I’ve already clearly stated I can maintain concentration for driving!

Your problem is not my problem!

Is that Ok? Or do you think because you don’t like something, you don’t feel able to take a call or want too, I have to agree and follow?

Let me make it clear, I won’t!

If (and that’s a very if) it becomes illegal, I’ll stop.

The fact that three things all affect concentration doesn't make any of them safer!
If something is happening in your car that means you aren't driving safely you need to pull off the road at the earliest opportunity

Its a fair few years ago now but there was a RTC that killed a woman driver and her children in Gloucestershire (I think)

She drove headfirst into a lorry

Poor lorry driver reported her looking backwards at the moment of impact

With a call u can hang up id distracting you. Will kids you can't. Now tell me they are equal

Thanks- useful to know. I have filled in the form already to confirm I was driver at that time, I just need to send tomorrow.

Good to know they send you the evidence, at least then I ca understand as I have no recollection of using phone at all

They will generally only send the evidence as part of a postal requisition or single justice procedure in preparation for a hearing.
I’d be inclined to send a covering letter explaining your hands free set up.
As an aside it’s not unreasonable to not answer a call when driving even if it is a meeting. I’d rather pull over or join the meeting once I arrive where I’m working.

You can ignore your children, turn up the music. You can’t really do that with a meeting with work.

That surprises me if you can ignore 2 kids fighting and a baby screaming easier than a phone call. My oh says half the people on these teams meetings are not paying attention to what's being talked about anyway
