AIBU? Sold as seen and I'm not willing to refund?

Hi everyone.

I sold a Nintendo switch on market place yesterday, the switch was fully working in the ad, I checked everything thoroughly and every part of the switch and doc worked.
buyer couldn't get a lift to collect so ended up dropping it to her.
she bank transferred the money to me and has now messaged me to say it's broken and doesn't work? AIBU to tell her it was fully working yesterday so it's now not my problem?
she's borderline harassing me at this point sending me message after message. I've said to her look on YouTube for help to set it up, or perhaps it's her TV that's the issue as the switch is fully working, I even played it for half an hour yesterday before I wiped to factory settings.

ooh keep us posted as to her last response before you block her. You may find she blocks you!

They don't refund faster payments for civil disputes. All banks work to the same rules and reimbursement models

If that’s the case, how come a close family member of mine received their money back after a scam purchase? I understand and appreciate what you’re saying, but I have first hand experience of receiving money back 🤷‍♀️

Scammy. Either ignore her and block. Withdraw the funds so you have them out your bank. Or text her and call bluff stating your partner videoed working the day before drop off so you’ll send that over later on, see if she says anything there.

Ultimately you know it was working, your dropped it off. Done deal. Block

This wasn't a scam purchase. It was seen as sold on Facebook Marketplace and the customer accepted and is in possession of the goods. It's also a faster payment and there is no protection like there is with credit/debit cards. It's like sending cash.

Result OP. They probably expected you to roll over and refund immediately. Either that or someone has shown them how to switch it on and they are excruciatingly embarrassed 🤣

Huzzah! Good call taking a photo of the serial number on the back. Looks like they've got their comeuppance today. Hope they actually wanted a Switch 😂

Who can say what the right thing to do is ? Anyone would be pretty fucked off if they bought something and it didn't work. I understand it worked when you played it but i personally don't see what she has to gain by lying.

I’m surprised no one has said this so far - bank transfers are not reversible, however, she can contact her bank and say she’s been scammed, paid money to someone under false pretences. Her bank will then look into it with your bank and refund her the money, not sure if the money may also be taken out of your bank.

That’s fraud.

If you still have the receipt, photograph and send that to her.

Nintendo will repair it for free. She just needs to call the helpline with the serial number.

They'll send a courier label if they can't solve it over the phone.

That way you've been more than reasonable.

The switch was first released 8 years ago. The vast majority of them will be long out of the warranty period now. I'm pretty sure Nintendo don't offer free repairs for life!

I only bought the switch this year from new, so it technically does still have warranty on it! I got it from Argos and it had another year and a bit warranty on it. I have already given her those details too :)

Out of curiosity, would you be happy if a shop only gave you one day refund policy? The buyer may have been working or otherwise busy.

And no, I'm not saying OP is shop and I have never said the buyer has legal recourse, I've said that FB is a place where you take your chances.

All I said is that I would check the item and OP has given the buyer an opportunity to demonstrate the issue in a very smart way which gives the buyer the benefit of the doubt but also protects the OP from having to refund in the event of a scam.

Shops don't have the capacity to check every single item that they sell; in fact, in most 'standard' shops, the goods will usually be brand new and sealed, so the customer wouldn't want them to open them in advance to check for faults, anyway.

It's completely different when you're selling a one-off item, second hand, which you have already used/tested before selling and you know that it works.

Yes, I heartily agree! They will have budgeted on getting it free - whether to use it themselves or to sell it on - so it's even sweeter knowing that they ended up paying out money unplanned - all because of their own dishonesty and desire to scam an honest seller!

I'll bet there are loads of people out there who deliberately look for very cheap 'broken - for parts only' electronics - not because they want to repair their own broken one, but so that they can use it to scam a decent one free out of an honest seller.

Glad it is over OP😀My aunt is 88 and asked me to get her a shredder. Had it sent direct from Argos. She said it was broken .., she had put the top bit on the wrong way😬

Your family member would have been a victim of APP fraud which is why they refunded the bank transfer. They won't refund if it's a civil dispute, you need to pay on a debit or credit card to have any purchase protection.
