Photo of husband posted on Facebook group with allegation - legalities?

Earlier I was alerted to a post by a woman on our town’s community Facebook page. It is a rant about a flat in her block being used by a group of prostitutes which is causing issues at unsociable hours and how the landlord isn’t doing anything about it. Under this there are photos of various men at the entrance of the block of flats and one of them is my husband. The insinuation is that these have all been visiting that flat.

I want to know the legalities of this woman posting such an allegation as she is outright refusing to remove the post. It is obviously extremely humiliating for me (friends and no doubt colleagues have seen it) and there’s so many comments underneath. We’ve been on a ‘break’ due to various issues but still living together and haven’t been intimate for nearly a year so I don’t need a lecture on how I shouldn’t have married such a man.

Is it me or is someone putting up a post like this without any thought for the consequences on various families etc utterly disgusting?

They sound very knowledgeable of the legalities and regularly reference their legal right to film, photograph and post anyone in public spaces.
Children may be an exception.

They're not an exception.

That's unsettling. I do have issue with all this. Another thread.... Impossible to police....😭.

You yourself need to work out where YOU need to go with this. Is this the step too far? Are you prepared to stand by him and forgive this? Or prepared to find loads of money to take it to court and find out later down the road hes still a bastard?

Don't blame her for her husband's disgusting objectification of women. Men who get lots of sex go to prostitutes. They actually prefer it because they feel free to do abusive and disgusting acts their wives wouldn't agree to and because they like sex to be transactional, not relational.

Regardless of the situation with you and your husband and whether or not he used her services, it's completely illegal to post a photo of anyone without their consent. Same as registration number plates on cars. Unfortunately, most people lack this knowledge. Your husband can bring her to court for this.

Same as drug dealers don't.

Yet the families in so many of the tower blocks around here have theirs and their children's lives made miserable, by junkies, dealers and prostitutes buzzing the buzzer at all hours of the day and night.

A lot of kids have to face these people in the lifts and on the stairs on a daily basis.

It's bloody selfish.

Some do. Obviously I don't know about this case, but I once went to a podiatrist-I had moved to a new town and just googled-and it was a house. She treated me in the hall which seemed weird, but apparently not uncommon, there's also a doctor who does treatments from her home in our town. I'm no expert, but it might well be legal as long as they record all details correctly.
In any case, the person posting is affecting innocent children of the men, if it is absolutely innocent. As I say, I don't know, but it could be, so I can understand OP's anger. I wonder what all these people saying it's fine would be ok if their picture was published when they were only visiting somewhere for medical treatment?

This should be a black and white case of libel.

What she has are photographs of men at a block of flats. They could be doing anything there, such as visiting friends. We don't know what they were doing unless she has evidence that they went to a specific flat, gave money to someone, and that money was specifically in exchange for sex.

The issue is that her allegations have real consequences for people.

If there is nothing wrong with using prostitutes, there is nothing wrong with everyone knowing about it. As you are choosing to be a doormat, apologist and defender of this excuse for a man, your life will continue to get worse. That's unfortunate but entirely your own choice.

How do you know any of these men were visiting prostitutes? There's no evidence for that, and OP hasn't indicated there is any evidence. She said a woman has photographs of men visiting a block of flats. People enter and leave flats all the time, for a multitude of reasons.

It doesn't matter, at all. If they were innocent, they will be fine. If they are guilty, they will also be fine. It's not illegal to use prostitutes, so they will suffer no punishment at all.

Literally the only people they have to worry about explaining themselves to are their families and that will be fine too if they are innocent.

I always laugh at the notion that men are actually punished for this sort of behaviour, there are men all over the world in positions of massive power who raped women, beat women, everybody knows, nobody cares.

She is doing a public service to their wives, and I hope her posts stay up and she keeps posting.

Public vs. Private:
While taking photos in public is generally permissible, posting them online without consent can still be problematic if they are intrusive or cause HARM.

If it’s true then I am not sure there is anything you can do. His reputation is his problem not yours. If he does not want people knowing he visits sex workers maybe he should not visit sex workers.

Must admit I am laughing at the pearl clutching on this thread, some men got their pictures taking going into a brothel "QUICK CALL THE ROZZERS ON THE WOMAN FOR TAKING THE PHOTOS! THOSE POOR PROSTITUTE USING MEN WHO WILL NOT BE PUNISHED IN ANY WAY, HOW DARE SHE?!"

Well legally it could be defamation - her post implies your husband has been partaking in illegal activity. Your husband would have to lodge a civil claim and the woman would have to prove he was paying for sex. If she can't, he could win the case.
If she could, he wouldn't.
Based on what you've said, she couldn't prove it at all - him being outside a block of flats does not prove he was visiting a particular flat and then paying for sex within it.

The reality is this sort of thing costs thousands and thousands of pounds to pursue.

Your husband could report the photo to Facebook asking for it to be removed - citing defamation etc.

He could also message the woman directly threatening defamation.

Facebook are utterly useless. My friend was going through a marriage break up a couple of years ago. Her exh took it badly and was posting (completely false) defamatory claims about her daily on his public page. Posts were reported by multiple people, but nothing was done and no posts were removed.

I was initially feeling defensive of the prostitutes who probably have limited choices. And then I thought about living next door to it as you highlight. And I'd be raging you're right.

The issue for me are the ' punters' anyway. As if paid sex with a prostitute is the only way they can access sex. I don't believe that. I feel there's a grotty undertone to it. They disgust me over the women.

Still would be pissed living near to this.
