AIBU to think I have no liability here? (diagram attached)

I think I'm fairly sure on this but can't stop panicking so I thought I'd ask on here.
Friday night I had a car accident. It was a real shock and it's only now that I've stopped to think about it that I'm feeling really really cross.
In the diagram I'm the blue line, the other driver is the green line. The thick lines show where we went, the thin lines indicate where you would have expected us to be going. Given that the lady tried to tell me she'd been going straight on when obviously she didn't makes me wonder if she had a mad moment!
Anyway, this particular roundabout leads onto a bridge over a dual carriageway. On the other side of this bridge you can go left onto a local road, or right to join the dual carriageway.
When we joined the roundabout, the other car was to my left. Neither of us indicated before joining the roundabout, however I did indicate left after I passed the 1st left exit as I was planning to go over the bridge and turn right to join the duel carriageway. As I was about to leave the roundabout the lady turned in front of me to head back round the roundabout and I hit her in the side of the car. Slow speed, maybe 15 mph.
It turns out that we have the same insurance company just to complicate matters.
I'm pretty sure that she is liable for this accident, what do you all think?

YABU: you are liable
YANBU: you are not liable

Rule of thumb says if you are going straight on you should be in the left lane. Have I missed something?

No you’ve not missed anything. If you’re going straight on you’re exiting at 12 o’clock. If you’re exiting after 12 o’clock you go in the right lane.

ReadingSoManyThreads · 01/07/2025 21:29

Great news! Well done!

Thank you!!!
I think I'm always going to be nervous on it now, but my new dashcam arrived today so once it's installed I may risk it. I think I may be circling that roundabout a lot in rush hour though as I'm not sure I'll ever have the guts to exit if there's another car next to me again!

Well make sure you circle in the right hand lane not the left! 😂

Honestly, they say lightening doesn't strike twice, it does seem like a random moment of madness on her part rather than an error most people would make, so I think you'll be absolutely fine! Don't let it beat you!

The reason this thread has run to so many pages is because of the fact a great many people didn't know it is acceptable to use the right-hand lane to go straight on, where signs and arrows do not state otherwise.

However, with driving it's always best to consult with the highway code and not the "rule of thumb"

@grumpygrape @PumpKim and all others that reassured me that I wasn't to blame............ the insurance company has just let me know that the other party is 100% to blame, and I don't have to claim on my insurance. I'm soooooo relieved. Looks like the reams of diagrams, map screenshot etc I sent to insurance assessor actually did the job. Thank you all, I had no idea how invested you all would get in this!

I am so pleased to hear this. Has the insurance company told you on what basis they can prove the other driver was at fault? It's a good job there were hatches to mark where the car shouldn't have been, thus proving the point, as anecdotally it's unusual for a roundabout incident to not go 50/50. Mine certainly went 50/50.

I too hope WiggyClawsThe2nd continues using the junction, boosted in confidence with the Dash Cam.

Wouldn’t it be good if just a couple of the naysayers apologised for being so obtuse and criticising WiggyClawsThe2nd for actually doing the right thing ? I’ll not hold my breath….

That would be nice.. I won't hold my breath either though!

I actually think that some people will still believe she switched lanes without looking and it was still partly her fault, but they'll all pipe down about it now she's been exonerated at least!

I doubt it, they'll be a fair few sitting reading this with sparks coming out of their arses, thinking "THIS IS WHY OUR PREMIUMS GO UP!!!".

WiggyClawsThe2nd · 30/06/2025 12:57

Really? I think if they try to put any liability on me I'm going to fight it. In my head, she caused the crash so she bears responsibility for it. I do wonder if having the same insurance company is a plus or a minus in this situation.

Please fight this wiggy we had nearly the same thing happen to us, we fought it and won. (We hadnt turned though the other person actually crushed us into the roundabout). The insurance company kept hassling us to go 50:50 we said no we are going to court and they made the other side pay up.

I dunno, but Joe-Public always knows best, and it's been said that it does.

I had a very expensive accident a several years ago, all my fault, and my premiums hardly moved. Three years ago my insurance dropped in price by almost £300 for the year, for no reason I knew of.

A year later, it went back up by almost the same amount, again for no reason I know of. I have long stopped speculating as to what does and doesn't affect the premiums.

No they haven't, and I was so delighted I didn't ask! I think I mentioned how lovely and kind the other driver was after the collision, I think maybe she just admitted she was at fault! I'd like to think so anyway.

PumpKim · 02/07/2025 06:57

@WiggyClawsThe2nd glad you got the right outcome.
Are there really still people saying left hand lane only for straight on 🤯 Two lanes on, two lanes off. Stick to your lane is the only rule of thumb here and the other driver crossed from left to right.

Nomnomnew · 02/07/2025 08:17

@WiggyClawsThe2nd have been watching your thread with total bafflement at how many people clearly either can’t read or can’t drive (or perhaps both!).

I’m glad you got the right result from your insurers, but extra glad you were able to update the thread to show you were right and all those banging on about changing lanes and never going past 12 o’clock and whatever other rubbish need to review their driving! It’s a bit scary how many people seem not to understand! 😳

Kjpt140v · 02/07/2025 10:51

No you’ve not missed anything. If you’re going straight on you’re exiting at 12 o’clock. If you’re exiting after 12 o’clock you go in the right lane.

Therefore both drivers were in the wrong?

glad you got it sorted-eoither way they have to pay out as your both with the same company

TwinklySquid · 03/07/2025 22:17

I think you were both in the wrong lane.

i was taught if you are going past the “12 o’clock” point , you would be in the right lane. So she should have been in the right as she’s going past that point.

You were going for the “12 o’clock” position, so you should have been in the left hand side, indicating after the first turning.

I think you are both a fault.

If you had read the thread, or at least the OP's posts, you would have discovered both the OP and the other car entered at 6 o'clock and the only exits the other driver would reasonably have used were 9 and 12 o'clock. There is no exit at 3 o'clock. Neither OP, nor the other driver were in the wrong lane to exit at 12 o'clock.
Not only that, OP has confirmed her insurance company says she was not at fault and as they are also the other party's insurer we have to believe them 😉

The insurance company clearly should have consulted you on this one, before telling to OP she was not at fault.
