They’ve attached a GIANT fence… to MY fence !!

Exactly that !

Neighbour behind has a 6 foot old wooden fence.
I have a 6 foot fairly new 6 foot fence of the concrete posts and board variety.
There is a 2 foot ‘No man’s land’ in between that the builders of my house/estate left when they erected this perimeter fence (we are on edge of development).

Came home today to find neighbours erecting a fence with 12 foot posts and 10 foot panels ! It’s flipping huge !

On Inspection, I can see he’s attached said monstrosity to my nice fence by drilling holes in my concrete posts, and attaching wooden battens which form a framework with metal brackets that bridge the 2 foot gap !

I asked him to take it off my nice fence - he turned his drill on and turned his back to me and carried on. It’s now fully installed.

I’ll try and upload photos for you all to appreciate his workmanship.

AIBU to contact Council ?
AIBU to saw the metal brackets half way ?

My understanding is that he cannot do anything to your fence. Seek advice.

I really don't know what I'd advise in this situation OP, but he clearly has no right to attach his fence to your property. I think you might have to seek legal advice with this. Is he even allowed to put up a 10 foot fence, I thought 2 metres was the limit?

Sounds like a land grab. Who owns the land? If it’s the council you should let them know.

Legally he can't do anything to your fence. I'd be instructing a solicitor.

Well the first step might be to check out ith /inform the council as a 10ft fence needs planning permission.

In theory if he has drilled holes in your concrete posts this is criminal damage but the police may be unlikely to get involved in something they will dismiss as a " boundary dispute"

Do you have legal cover on your home insurance?

As a last resort you could remove the battens as close as possible to your own posts - but he is clearly a CF so you have to think about how hewould react....

Cannot erect a 10 ft fence, it’s illegal. Contact Development Control in your local authority’s Planning Dept.

I've just done a bit of research OP, and I was right there is a 2 metre limit on fences between neighbours in the UK. Anything else, and he needs Planning Permission. So I'd call your local council first thing in the morning, and find out exactly where you stand.

If the fence is taller than 6ft then he likely needs planning permission. And either way he shouldn’t be attaching anything to your fence.

So, has he done a land grab and moved his fence further out, or just used the gap to build the weird fence support structure?

Bloody hell!

He had absolutely no right to attach anything to your fence or posts. It’s classed as criminal damage.
As PP said, I would check your insurance for legal cover and get advice.
I would also contact the council as he can’t have a fence that high.

Over a certain height needs planning per,is soon. I would also unscrew the fence from your posts and tell him he doesn’t have permission

Another thought - what is the size of the gap between the fences? I am struggling to see the purpose of his battens if his fence is secured with 12 foot posts?

If you can lift the panels on your side you might be able to unscrew said battens from your posts....

Council, quick. Don’t take it off as that can be seen as criminal damage but pursue council/planning aggressively. Most councils wouldn’t allow such a tall fence.
