They’ve attached a GIANT fence… to MY fence !!

Exactly that !

Neighbour behind has a 6 foot old wooden fence.
I have a 6 foot fairly new 6 foot fence of the concrete posts and board variety.
There is a 2 foot ‘No man’s land’ in between that the builders of my house/estate left when they erected this perimeter fence (we are on edge of development).

Came home today to find neighbours erecting a fence with 12 foot posts and 10 foot panels ! It’s flipping huge !

On Inspection, I can see he’s attached said monstrosity to my nice fence by drilling holes in my concrete posts, and attaching wooden battens which form a framework with metal brackets that bridge the 2 foot gap !

I asked him to take it off my nice fence - he turned his drill on and turned his back to me and carried on. It’s now fully installed.

I’ll try and upload photos for you all to appreciate his workmanship.

AIBU to contact Council ?
AIBU to saw the metal brackets half way ?

Yes, but you can’t attach it to your neighbours fence.

I’mall for privacy. Would love a 10ft fence all around us, but not if it’s going to cause damage to ours.

Fences over 2M in height requires planning permission. As a neighbouring property you would have been contacted for comment. Get in touch with the council's enforcement team.

I wouldn't dream of attaching it to neighbour's fence or fence posts. It's their property. But glad I can put my own posts and fence up.

So did I but I checked just before posting and Google AI informed me it was 2M, 1M if alongside a road. Sometimes AI does get things wrong.

The posts went in today the same time as the panels - there was no digging or concrete going on !!

I bet he’s used those metal post spikes (that clearly are not strong enough to take the weight of the monster fence) so thought he’d brace it with yours!

Builder here, drilling into concrete fence posts is a no no, you inevitably expose the re-bar and it corrodes, eventually spalling the concrete.

He has damaged your property, and that therefore needs replacement.

Quite aside from the legality of the fence height, in a strong wind, his fence will be pulling on your posts.

Don't cut his brackets, but you can undo the fixings, save them and give them back to him. go to a solicitor. You could have your fence taken down.

In the UK, the maximum height for a fence without requiring planning permission is 2 metres from ground level(just over 6 feet 6 inches). If the fence is next to a highway used by vehicles or a footpath of such a highway, the maximum height is 1 metre (just over 3 feet 3 inches).

Looks like he has used concrete screws to attach a beam to your fence when he has used to brace his own fence. Looks to have used an SDS drill on hammer action which has blown out part of your post. The concrete screws are probably hex head so would need a socket / spanner to undo....

Absolute CF especially if he has not concreted those fence posts. If the are 12 ft high above ground then he would have needed to sink them 4ft in the ground.....

Do you anyone capable of helping you remove that beam/ joist? He is relying on police not caring / treating it as a civil matter but ultimately that works both ways ....

It's be satisfying but risks him building a fence on your boundary and essentially stealing land which will take far longer to sort out. I'd let the council handle it.

No, because if the OP’s concrete base is still there that marks the boundary. The council will do jack squat.

I suspect a pp is correct in that he has a raised deck on the other side, which he also needs pp for as it probably exceeds the 1 ft level

If his garden slopes down towards that fence he might get away with it though ( I believe the ground level from highest point/ house is sometimes used as a reference point)
