They’ve attached a GIANT fence… to MY fence !!

Exactly that !

Neighbour behind has a 6 foot old wooden fence.
I have a 6 foot fairly new 6 foot fence of the concrete posts and board variety.
There is a 2 foot ‘No man’s land’ in between that the builders of my house/estate left when they erected this perimeter fence (we are on edge of development).

Came home today to find neighbours erecting a fence with 12 foot posts and 10 foot panels ! It’s flipping huge !

On Inspection, I can see he’s attached said monstrosity to my nice fence by drilling holes in my concrete posts, and attaching wooden battens which form a framework with metal brackets that bridge the 2 foot gap !

I asked him to take it off my nice fence - he turned his drill on and turned his back to me and carried on. It’s now fully installed.

I’ll try and upload photos for you all to appreciate his workmanship.

AIBU to contact Council ?
AIBU to saw the metal brackets half way ?

You tried ro speak to him and he blanked you and carried on drilling? Cheeky bastard!
I would be out there with a saw! However in the interest of keeping things partially civil at least, contact the council asap.

Might also be viewed as denying your right to light (if RTL is excluded it will show on your land reg title - you can download a copy for twenty quid I think). But yes it’s damage by drilling into your concrete posts.

And also yes to planning permission needed for that height of fence. Fuck em - cheeky barstools they are. How bloody dare they erect that monstrosity without checking with you.

It does look like his garden might be substantially higher than yours? I think the 2 meter rule is from the height of your own land - so if it's 2 meters high from his side it's fine planning wise. Shouldn't be attaching stuff to your fence though

Either his garden level is 6ft higher than yours, or he is building a raised deck. It looks like a deck to me, hence him thinking his fence is only 6ft on HIS side. But I think decks can only be a certain height also, someone might confirm.

The bloody cheek of him to use your posts as batten holders and then to carry on as if you don't exist. I'd be livid with that attitude for starters. If he had been anyway civil I'd have listened, but not after that performance.

In which case it is restricted to 6ft (or might be 2 meters) from ground level. In other words, it might not be pretty, but it might be legal.

He still can’t attach it to yours though.

6 foot is the usual limit, so it depends on his ground level.

I don’t think I’d be too annoyed by the fence height - it’s not hiding a nice view and I’d put trellis or pleached trees or potted bamboo on my side to pretty it up.

But I’d be furious about drilling into your fence posts. The cheeky sod.

The posts went in today the same time as the panels - there was no digging or concrete going on !!

You can see the top of his original fence in the photo. It’s a foot higher than the OP’s at most. And the only reason he needs to drill into her concrete is because it’s going to be like a sail in a strong wind.

I’d be at b&q for it opening tomorrow for an electric saw and I’d cut the whole thing down to 6ft. Probably in wavy lines too just because he turned his back on you. He’s a Cheeky cunt.

You only have a right to light to a habitable room that doesn’t have other windows.
A garden doesn’t count

Looking at the photos, the other house looks quite a bit higher than yours. In photo #2, your take a photo is taken at the top of your fence, 6' up, but he is at waist level, so he's starting from higher. The panels in the distance look standard size, so he's not putting up a 10' fence as you claim, it looks like a perfectly legal 6' fence, but just on higher ground

Hmmm looks like his ground level is much higher than yours therefore 6ft on his side could well be 10ft from yours so he may not be in the wrong when it comes to fence height

It might only be a 2m fence from your side if his garden is higher. However, he can’t attach anything to your fence.
