Supreme Court rules the term sex refers to 'biological women'

Finally.

There is no “triumph” for me.

i am delighted though.
I feel relief that this reasonable request for clarity has been heard.

The judge also said “the law still gives trans people protection against discrimination.”

As it should do. No one ever argued otherwise.

Thank goodness for common sense. It’s like waking up after a very vivid dream and finding out that the world hasn’t gone completely crazy after all.

Brilliant! Feeling emotional.

None of it. Which is why I’m confused. The only argument I’ve ever heard from “trans activists” is that there is a difference between sex and gender. Where sex (ie biology) is relevant (such as in sporting events), only biological females should be allowed. I thought that was a given.

There's a list as long as my arm of men who've 'won' in the female category of a sporting event in the last few years by insisting we had to accept they were now 'female' - have you not seen any of them? None?

And in other news, the Pope is Catholic and the Earth is a sphere.

Has JK Rowling made a statement yet?

catgirl1976 · 16/04/2025 12:17

Can we change International Women’s Day to today given we are now finally allowed to know what one is?

I am hoping it might lead to a reconsideration of how to make trans people feel safe in the spaces allocated to their biological sex. Not an issue for transmen, but for transwomen the current solution of 'making women budge up and shut up otherwise be accused of discrimination' has been judged incorrect. Male spaces should be safe or have accommodation for all who are born male.

I am inclined to shrug my shoulders and say well that’s a problem for the men to figure out, because quite frankly I am a bit weary of it having been seen as womens work to accommodate transwomen, and I think we can now put that issue firmly back where it belongs.

We have always supported the protection of single-sex spaces based on biological sex.

Im not sure this is an entirely truthful statement, but hopefully this ruling eliminates their wiggle room.

I recall Sir Keir has always struggled to use the words (and concept?) of "single sex spaces".

Still, as he's allegedly moved on from telling us that we shouldn't say only women have a cervix, on this marvellous day for truth and sanity, I look forward to hearing his next utterances. 😅

I am also hoping that the SNP, who gave us all this nonsense and wasted so much of our money on it and arguing that Isla Bryson was as much of a woman as I am get annihilated at the Scottish elections next year. The total kicking they so deserve.

Of course I have. My point is that any trans supporters I have come across IRL (including trans people) agree that this is a piss take. They agree that sex =/= gender. It’s known within that community that there is a right wing push to suggest otherwise, and it (generally) doesn’t come from trans people themselves.

Hwi · 16/04/2025 12:21

No????? That is a surprise.

theDudesmummy · 16/04/2025 12:23

This is wonderful! But is there any room for wiggling regarding the term in the ruling "biological woman", a la Dr Upton, who is "a woman" and is biological, therefore a "biological woman". (I would have said no, but his argument was so batshit yet put forward in seriousness in an actual legal setting so...).

So all the trans identified men competing in womens sport are not pushing this themselves they're just victims of right wing agitators?

TheKeatingFive · 16/04/2025 12:26

We good to see attempts to spin this as 'the right ring's fault all along' are already in full swing 🙄

The point is that women are oppressed based on our SEX class. Not 'gender'.

And female only spaces and rights are based on SEX. Not 'gender'.

And most of us are left wing feminists. If the right wing side are taking this up, it's only because the left abandoned womens rights and left it for the right wing to opportunistically take it up. And they'd be mad not to. Given that females are 50% of the voting population.

Thank goodness!!! Cue weeping, wailing & gnashing of teeth on X; I'm off to have a look in a minute 😆😉🎉🎉🎉

skipdiddyskip · 16/04/2025 12:27

This is a lovely opinion to see on MN. Sometimes I worry that some of the talk on the subject goes too far. Recognising and celebrating a decision that supports that “woman” refers to biological sex while also accepting that trans women require legal protection from discrimination is such a balanced way to look at it!

UnctuousUnicorns · 16/04/2025 12:27

"I think we'll be headed for third spaces/categories/definitions; male, female, and gender neutral."

For "gender neutral" read, "just stick a combined male/female symbol - and maybe a rainbow sign - on the door of the sole accessible toilet, cos we're so right on, innit." So now perfectly able bodied, no disabilities, visible or invisible, Johnny who's decided he's Joanna for the day, is "entitled " to use it. 🙄

Yes, and important, but also weirdly depressing. It’s like the SC having to confirm that, yup, gravity is still a thing.

Yep. Or having scientists confirm that the earth is round

Arraminta · 16/04/2025 12:30

DoddlesMcDoddle · 16/04/2025 11:45

Yes, if males feel unsafe in the male spaces (interestingly, gay men have never made the case that they are 'unsafe' in male spaces), then that's an issue males have to solve. Females are not human shields for males.

But it's never been about safety. Not least because there has never been one case of a transwoman attacked in male spaces (yet there has been cases of females being attacked by transwomen in female spaces), and many transwomen themselves say they've never been made to feel unsafe. But because the very fact they reject a call for third spaces/gender neutral, designed to give protection and privacy for them. If it was ever about safety, they would have embraced our third space compromise. But third spaces don't validate them as women. It's not the building itself. It's the females in that space that gives them validation as 'women'. Hence the rejection of third spaces.

It was never about safety, lets be honest; we all know it. It's only ever been about validation. Using the females in the space to validate them.

So true. And yet, oh the irony! Because the moment a TW entered any women only space every single other woman there would know a man had arrived. Have never yet seen a trans woman who wasn't (very obviously) a man in a dress.

Strange how so many men who identify as trans women have indeed come out with that exact argument, then isn't it?

Are you seriously suggesting that a) anyone who believes sex matters politically and socially and for ALL of women's legal rights are right wing? and b) the multiple prominent trans identifying males saying precisely this were just invented by the Daily Mail?

Pretty sure India Willoughby, who has stated that he even has a cervix and offered to show it to Andrew Marr on live TV, is a real person. Rachel McKinnon or whatever he calls himself now too. Morgane Oger. Helen Belcher. Dr Beth Upton of the Fife case who claimed he was a biological female and this was why women should be compelled to get changed in his presence. Multiple other prominent trans activists.

Please stop gaslighting. That these men and a great many more have claimed they are literally women and demanding access to women's services, spaces and sports is not an invention by the right wing. Perhaps those trans people in your circles could have spent a little more time fighting against those "activists" who claimed they were speaking for them and supporting equality and women instead of claiming it was all a right wing plot invented by or "fallen for" by evil terves.
