To not pay for an unwanted child?

Hypothetical.

it came up at work today.

if the pregnancy was a result of a one night stand, regardless of whether precautions were taken, if the man doesn’t want the pregnancy and the woman decides to continue, should he be able to opt out of child support?

my personal answer and I’m not sure on the nuance (ie do you have be on the birth certificate and thus can claim parental responsibility in order to be compelled to pay maintenance or a dna test to compel the man) my personal answer is no, he cannot or shouldn’t be able to opt out once the child is born. All sex (with a woman of reproductive age) carries the risk of pregnancy, you can lower the risk but never fully remove it. Abstinence is the only way to do that. To do the action you’ve got to be prepared for the consequences. It’s very easy to flippantly say ‘get an abortion’ but for some women that isn’t viable.

Hoping you read my original post of friend seeking to get pregnant by man with significant financial resources. Told him on pill when she wasn’t because she wanted baby with him (she didn’t do this with previous boyfriends who were not financially successful). She told us, I’ll get pregnant if we marry I’m set for life, if he doesn’t then I’m still set. They did not marry, she & baby got a city flat, private school, generous support so she did not work. He has moved on to other relationships, no other children that we know about.

And the other who thought her clock was running out and schemed potential to get pregnant at a professional conference. She researched participants SM, linked in for those who were intelligent (good uni), sporty and single and lived in another country. She got pregnant and never told him. She just wanted a free donor. She told him don’t worry I’m on the Pill when she knew 100% she was in ovulation phase.

Tell me to eff-off if you want, but these ladies exist.

In both of those cases, the mens stupidity is the reason for a pregnancy. Especially the second, Seriously, having sex with a stranger at a conference and neither care enough about themselves to protect against STDs. What luck that the conference lined up so perfectly for a pregnancy 🙄

These 'ladies' may exist but without stupid men, they would not succeed 🤷‍♀️

By 'results in a pregnancy' you make it sound like something that just happens with the woman being a passive bystander.

I'm talking about cases where the man clearly indicates he doesn't want to be a father and the woman continues with the pregnancy against his wishes, possibly even having lied about the pill like happened to the guy I know. Basically, forcing him into a situation which a woman would never find herself in.

Why shouldn't the mother pay towards the upbringing of the child if she decides and wants to be a mother, especially if the man who doesn't want to be a father has to pay?

no offence you would rather not be disappointed. See too many women in this situation having a child is a joint decision. If he’s told you no then you clearly cannot rely on him. It’s also unfair to the child

No, I dont think that a woman should be forced to have an abortion OR forced to have a baby, but we have a choice. I dont think a man should be forced to have one and then have to shoulder the financial burden of a decision he didn't make. Forcing a man to have a baby if a mistake happens is the same as forcing a woman to have a baby she doesn't want if her contraception fails.

I think you're missing my point

the responsibility of not getting pregnant is on both of them, and if women don't want to get pregnant there are multiple options of birth control for them

same for men

the thing I'm trying to point out is if men REALLY do not want to be responsible for a child resulting from sex then they absolutely have this 100% within their control

and they can still have all the sex they want with whoever they want, they just cannot ejaculate inside a vagina

and so there is no way that they can be "trapped" or suffer unwanted consequences if they take responsibility for where their sperm ends up

and if they do not take that responsibility then yes, biology means that they do not get to tell a woman she must have an abortion or keep the pregnancy, because at that stage it's not their body

Should she NOT be allowed to get an abortion if the man wants her to keep it? In the same way that he would HAVE to pay if he doesn't want it but she has it anyway? Shoukd the father take the mother to court so that she legally cannot abort the baby in the same way that she can take him to court to make him pay for a kid he never wanted?

No, because it is her baby that must carry and birth the child. Also why a man can’t coerce her into an abortion.

Absolutely you should not be able to opt out. It takes two to tango and if you really don’t want a child that much (man or women), guess what, don’t have sex, or do and accept that even with contraception there is a possibility of it in which cause you are both just as responsible for contributing for whatever the outcome of that might be.

He might not want this baby or have wanted a baby at all, but that becomes irrelevant if a baby is conceived. What the father did or didn't want has no relevance. He now has to face the consequences of his actions.

As has been pointed out on a number of times. Child support is for the.....child. A child that has two parents to support them.

I did. If the woman has a duty to inform the man of her fertility or else be labelled a con-woman then surely the man also has a duty to inform the woman. If he does not then he also is a con-man. He never told her he was fertile and neither did she inform him. Both were equal in not informing the other. A woman coming off her pill is the same as what he did. He stopped his condom use. Neither informed the other they were fertile. Neither took precautions.

Or like adults we can assume that both are fertile and both take responsibility. His lack of responsibility contributed to this. Men who take responsibility for their penis and what comes out of it cannot claim they were trapped.

How many men use this line to get away with their lack of responsibility?

No because the woman could've opted out of the pregnancy. If she's continuing the pregnancy the odds are pretty high she actually wants the child...it's a bit different paying for something you wanted and chose to have vs something you didn't.

women aren't entrapping any men into having babies

men are willingly consciously doing the thing that creates babies without considering the consequences of their actions

if I go to a casino with $100 to gamble, because I like gambling because its fun, then I don't get to complain if I lose and do not win during my visit

it's not the casinos fault I lost all my money, it is the consequence of my decisions

if I don't want to lose all my money then I need to either not gamble, or practice some risk management rules about how I spend my money at the casino

again, if men REALLY do not want to become fathers then they absolutely have 100% control over that outcome

they don't have to take her word that she's using birth control, they can still have intimacy and still orgasm, they just shouldn't be doing that one thing

Realistically, the alternatives are not that great for men. A lot of women don't want to have anal sex and men are not as stimulated by oral as women are as the clitoris is many times more sensitive than the penis.

And good luck to any man that tells a woman "I don't want to have sex with you in case you get pregnant". He'd be written off as a nutter. 😂 Women will absolutely not accommodate this line of thinking.

So what we're really saying is that it's just tough shit and men need to suck it up. No wonder so many men are complete bastards when it comes to supporting their kids!

It's a perfectly valid suggestion IMO to say that if somebody can prove that they already stated their desire to not be a father then they shouldn't be expected to contribute.

Otherwise, we might as well just tell women with abusive male partners "oh well, you could've completely avoided it by not dating a man".

Or we could tell women facing workplace discrimination that they didn't have to have a baby.

Well, condoms break don't they? And when they do only one of the sexes has to worry about being forced into paying for an unwanted child.

I don't get your point about men 'jizzing in her'. Lying about wearing a condom is legally classified as rape and a man was actually jailed for four years for this exact crime last year. Maybe it's time women who lie about taking the pill are charged as rapists!
