To be livid with work- I’ve been moved dept and given pay cut

With no notice -as of next week they want me gone

no improvement plan or disciplinaries (but new manager)

My family circumstances (4 kids) have been challenging the last year which they’ve been accommodating with - they’ve said a move would be better for them/me as I have have children and the hours their will better support my needs.

I do NOT want to work there. I’m shaking and so angry the way this was done. I was completely side swiped.
can anyone advise?

No my colleague who also has children has been there 18 months
ive been with the business on and off for 20 years. In this role for 5 years.

This restructuring sounds wrong. Please don’t get caught on your phone at work though, they can use that against you. Contact ACAS and make an appointment for a formal meeting with your manager.

Where was she discriminated against in the basis of sex?
On being a parent yes but that isn’t a protected characteristic.

I cannot believe they can just cut your pay though. Is your higher wage in your contract? Or was it made up of bonus/ overtime?

contact your union, they can support you and give you legal advice

contact ACAS on the telephone

Ask your employees to have a meeting and clarify why you have been moved and why you haven't been given notice?

I thought in this scenario they needed to maintain your current pay for a set time period usually two years.

I have to say, though, the word 'restructure' fills me with dread. In my experience it's a way to get rid of people whose face's no longer fit by forcing them into jobs or hours they don't want so that they leave. It's always aimed at women usually older ones.

You should probably dust off your CV and start looking around.

I think the lowering of pay would be considered constructive dismissal (i.e., you're forced to take a job elsewhere because they're giving you less money)

Most companies can get away with shifting your roles around, it's usually written in the small print, but I think the lowering of pay is what you can pull them up on.

Speak to a solicitor. My old job did a 'restructure'. No kids/disciplinary issues/work problems involved, just got rid of my job, on very dubious grounds. Offered me another (on the same pay, to be fair) but at the company's other site (inconvenient for me) and different days of the week.
I got a lawyer, who said that those things were enough to give me legal protection. We ended up negotiating a settlement ie I got paid to go away quietly.

In my company we all had to take a pay cut in covid but that was an exceptional time.

I'm pretty sure you can only be essentially demoted as part of a PIP process.

Speak to ACAS and don't agree to anything yet.

There is obviously a bit of history that hasn’t been divulged so difficult to fully understand what has happened but as other have said, speak to ACAS and find out where you stand.
from an emotional perspective, I hope you ge through the day ok. There is nothing worse than being in work heartbroken. Keep strong and I hope you get sorted x

Precisely this, in my case. Although I'm not sure it was about age, just about my face not fitting.

I don't want to sound harsh but from what you have said it sort of sounds like you haven't been doing your job fully

Surely though, if that’s the case, the employer ought to just tell the OP straight and address the problem? Rather than risk compromising themselves by doing something to kind of nudge her out for pretend reasons

@AllTipAndNoIceberg they should but a lot don't really have the balls to be upfront. I have mainly worked in small organisations and awkward conversations are avoided completely! I'm not saying that is right just what I have seen

No we have the same job in the same dept. I spoke to one of the managers unofficially just now.

he said the reason is I’m underperforming and not doing as well as my colleagues.

Its the first I have heard of it -today

It'll be the lowering of your pay without any notice that you can do something about as there are strict rules on pay and wages.

It’s not a small business. A huge organisation. National.
thank you. I have a lot of information now that I didn’t first thing this morning.

They tried to sweeten this by telling me when they’re at their busiest I’ll be temporarily moved over to my current role for 6 weeks. Madness. If I’m not doing my job though. Why would they want me at the most crucial part of the year?

You hint that you have had problems at work and they have been accommodating. Sounds like the move could be justified. Have they given you a reason. Pay cut you can fight. Moving departments not so much IMHO. Have they attempted to find a solution? Not really enough information to determine whether or not you've been treated unfairly.

Don't resign.
