Neighbour trimmed the tree that hangs over in to her garden......but

She chucked all the bits she trimmed over in to my garden

Is this normal?

I don't mind her trimming it - trees grow - but I'm pissed off that she threw it all over in to my garden

Trees planted closed to boundary are a pain. You might love it but clearly your neighbour doesn't

No she wasn't. She actually broke the law by fly-tipping. Legally, she has to OFFER them back, but if the OP declined or wasn't even asked, then it is illegal for her to fly-tip them into her garden.

Legally that’s what she has to do. She can clip your tree where it overhangs her land, but she has to return the clippings to you.

No legally she has to offer them back. If you decline them then she has to dispose of them herself.

It's the law, they belong to you.

It's NOT the law. The Law is that she has to OFFER them back, but she CANNOT fly tip them if the OP declines, or she doesn't even bother to ask OP in the first place.

The law is that the trimmings belong to the tree owner. The law is a lot less clear about they are returned to the tree owner. Chucking them back over the fence is understandable but not what the law requires.

The law is not terribly helpful in cases like this which is why neighbours are strongly advised to sort it out between themselves.

Not true. One must offer the ‘trimmings’ back (usually this would involve any fruit, for example), but otherwise, the trimmer must dispose of the garden waste themselves.

I don't care what the law is. It's absolutely frustrating that a neighbour can allow their shrubs, trees ect to get out of control and then we have to maintain it on our side as we have no choice.
We've had to spend a considerable amount on petrol going to the tip removing it all - is that fair?

Your tree, your trimmings. You can have a war with your neighbour over the trimmings but you will only cause animosity.

Some people don't care about inconveniencing you it's about them and how they feel.

No, this is incorrect.

Legally, she has to offer the clippings back, but if you refuse them, she has to get rid of them - chucking them over the fence in that case is fly tipping.

As far as I've been told (very recently) she's entitled to chop off any over hanging branches up to the boundary line. These she must offer back to you, but not just throw over as this is classed as littering.
