Neighbour trimmed the tree that hangs over in to her garden......but

She chucked all the bits she trimmed over in to my garden

Is this normal?

I don't mind her trimming it - trees grow - but I'm pissed off that she threw it all over in to my garden

Which bit?

Anything that stems from the tree (whether on your side or not) remains the property of the owner.

I admit the fly tipping comment was flippant, but the legal position wasn’t.

If it’s your tree she is allowed to cut it back to the boundary line . As the tree is your property she is meant to ask you if you would like the trimmings back as legally they belong to you . As your tree is over hanging her garden she probably isn’t overly happy . Personally I think you would be silly to make the issue worse by complaining about her giving you back your branches it’s not going to end well .

No - it’s fly tipping.
Yes, legally the trimmings belong to you, but people seem to know that they are allowed to cut overhang, and that trimmings belong to the owner of the tree/shrub but miss out the bit where they are supposed to offer them back to the owner not just chuck them over the fence, or else be guilty of fly - tipping.
(as you can see from lots of replies already)

Can you provide the source for this claim? I understand the opposite is true, in that the cuttings belong to the owner (neighbour) and should be returned or permission sought to dispose of them yourself.

You should be trimming your trees, rather than letting them grow to the point that the neighbour has to cut them...

That's probably why she threw them back in your garden.

@Likewhatever the bit where she threw them over to 'offer them' you need to have a conversation to offer them, not just chuck them back.

At that point the pruner is the fly tipper. I agree that if the op then throws them back to the pruner then the fly tipping is on them...

Why so dramatic, just stick them in the garden waste bin, a trip to the dump is not necessary.

I have a lot of sympathy for your neighbour - she's had to spend the morning cutting back your invasive tree.
You also expect her to spend the afternoon going to the tip to dispose of it.

No,she has to offer them back. If she doesn't or OP says no and she chucks them over it's classed as fly tipping.

Incorrect. The law says you have to offer the clippings. However if the neighbour says they don’t want them, then you have to dispose of them yourself, not
dump the clippings in their garden.

Nope. You're supposed to offer the trimmings back to the homeowner, they don't have to take them and you are responsible of disposing of them. You don't just throw them over the fence!

It isn’t you know. It says that anything that stems from the tree is the property of its owner and therefore must be offered to the owner. It isn’t very clear on what to do if the owner declines to accept them.
