Accidental crime...

NC, because I have become an inadvertent criminal.

This sounds unlikely but it true and I would like some advice and insight.

I was out today with a friend, lunch, galleries, bit of shopping. Tapping away merrily with my card.

My husband met me at the station to pick me up and I said I needed to go to the supermarket to get something and he asked what I'd been paying with all day because he had my card in his pocket.

We'd been away at the weekend and he'd been using my card because that was the card we had on us, I have a premium banking product and my card is very distinctive. I'd checked that I had my card in my holder before I went out today because I knew We'd both been using it at the weekend. Saw it was in my holder and have been tapping away all day.

The card I had in my holder and have been merrily using all day, is not my card. It belongs to a man I've never heard of. The only solution I can see is that I picked his identical card up that he left on a table and I assumed it was my card.

I have been spending a stranger's money all day. Shall I just phone the bank? Won't I look like a criminal?

TL;DR. I have accidentally spent some blokes money all day. I don't know what to do!

Because at the point you've realised and decided not to do anything about it, you've dishonestly appropriated his money with the intent to permanently deprive = theft.

Think of it a bit like you went to fill your car, not knowing you had no way of paying with you. Car filled and it's now in the tank, can't give it back. Oops, can't pay. Two choices: go into kiosk and fess up, work out how to resolve, or drive off like a loon and have no intention of paying. It's the point you do the latter that it becomes theft, not the point you filled the car, as you didn't know then that you couldn't pay.

@VanGoghsDog - none of my (admittedly new over the past 6-9 months) cards have the account details apart from my name on them. None of my accounts are exclusive.

If you don't call and sort, you've stolen the money. The point you decide to not sort is where the mistake becomes dishonestly appropriating with intent to permanently deprive. Which is theft. So it's the money you've stolen, not the card.

You do realise that at least one of the places in which you’ve used that card will have nice, clear, time-stamped cctv of you making that transaction, don’t you? And that can be shared with the ‘feds’ (come on, try harder!)? You’ll then have to explain to the satisfaction of an investigating officer how it came into your possession. Not reporting your ‘error’ as soon as you discover it will do nothing to reassure them that nothing nefarious has gone on. I have no idea why you’re being so blasé. It’s still not legal to use someone else’s money without their agreement even if you have a ‘premium’ card.

Yes, I realise that.

I also guarantee that I wasn't making purchases to my home, that there is zero percent chance that any bank will be interested in asking the police to chase me down. Actually from a pragmatic view it behoves me to do nothing. That would be the cheapest and easiest route for everyone.

There's an emergency contact number on bank cards. It's manned 24 hours.

Just bloody phone them.

Oh and I've got a fancy pants bank card with no embossed numbers or name on. It's because they're printed on the back.
