Accidental crime...

NC, because I have become an inadvertent criminal.

This sounds unlikely but it true and I would like some advice and insight.

I was out today with a friend, lunch, galleries, bit of shopping. Tapping away merrily with my card.

My husband met me at the station to pick me up and I said I needed to go to the supermarket to get something and he asked what I'd been paying with all day because he had my card in his pocket.

We'd been away at the weekend and he'd been using my card because that was the card we had on us, I have a premium banking product and my card is very distinctive. I'd checked that I had my card in my holder before I went out today because I knew We'd both been using it at the weekend. Saw it was in my holder and have been tapping away all day.

The card I had in my holder and have been merrily using all day, is not my card. It belongs to a man I've never heard of. The only solution I can see is that I picked his identical card up that he left on a table and I assumed it was my card.

I have been spending a stranger's money all day. Shall I just phone the bank? Won't I look like a criminal?

TL;DR. I have accidentally spent some blokes money all day. I don't know what to do!

Can't have been tapping 'all day' as every 5th tap requires PIN authentication (can be fewer taps if you've spent close to the £100 limit for a couple of taps).

Mine doesn’t. I haven’t been asked for a PIN in months.

Posting consistently from 9.30pm to 6.30am after a 'long lunch' in the afternoon without a break to sleep is impressive.

A similar thing happened to me years ago when you had to sign for things. I accidentally swapped cards with a friend and then we each spent a blissful day spending each other’s money. It was only when we wanted cash that our little gallop stopped.
OP - good luck in dealing with the bank today. If you get nowhere as you won’t get past security, try LinkedIn for the individual.

And whilst it was an accidental crime not reporting it straight away when you realised means that you have stolen as you are delivering keeping it overnight. I had sympathy upon reading your first post but now have none and if you get in trouble for this then it’s probably deserved. I hope you got up early and rang first thing

I think I said earlier, menopause has robbed me of sleep.

(Very cool name BTW, I was at Manchester Art Gallery today and the Sapphos painting by Mengin there was considered to be so erotically confronting that only Men were allowed to view it)

I think that the poster was trying to say that I only possibly had the card that I did because it was my husband's.

But also hedge betting that it was all bollox anyway...

I'm laid back about it because it's a genuine error, not even theft by finding, it's an error. At the moment there's no criminality.

As soon as I realised what was going on, I stopped using the card and I'll call the bank tomorrow.

I'm not culpable. It's a crazy mix up.

Why wouldn't I be laid back. The feds are not going to be breaking my door down tonight or any other night.

Because it’s not all about YOU. Especially as you were the one at fault.
Maybe you shouldn’t be laid back because you could resolve what is most likely a very stressful situation for the man whose card you have?
I think your only motivation for putting this right (and even that’s limited) is in case it affects YOU by you being accused of criminality. You aren’t considering the person you’ve taken the money from AT ALL. It’s shocking.

I'd be too scared to ring up in case they charge me with theft. I need a clear crb for work. I'd immediately cut up the card and say nothing. The card holder will realise his cards missing and report it, he won't have to pay anything, unless it's a debit card? Sometimes doing the right thing can actually backfire.
