Accidental crime...

NC, because I have become an inadvertent criminal.

This sounds unlikely but it true and I would like some advice and insight.

I was out today with a friend, lunch, galleries, bit of shopping. Tapping away merrily with my card.

My husband met me at the station to pick me up and I said I needed to go to the supermarket to get something and he asked what I'd been paying with all day because he had my card in his pocket.

We'd been away at the weekend and he'd been using my card because that was the card we had on us, I have a premium banking product and my card is very distinctive. I'd checked that I had my card in my holder before I went out today because I knew We'd both been using it at the weekend. Saw it was in my holder and have been tapping away all day.

The card I had in my holder and have been merrily using all day, is not my card. It belongs to a man I've never heard of. The only solution I can see is that I picked his identical card up that he left on a table and I assumed it was my card.

I have been spending a stranger's money all day. Shall I just phone the bank? Won't I look like a criminal?

TL;DR. I have accidentally spent some blokes money all day. I don't know what to do!

The man and the bank can prove his card was used fraudulently, was missing - they can prove theft and fraud based on what they already know.

How can the OP disprove the above, what evidence does she have.

The bank will have the stolen card in her possession and her use of it, which would I imagine be a slam dunk in court.

Well, to state the bleeding obvious, but I imagine notifying the bank and paying the fictional stranger back would absolve one of their fraudulent criminal activity. I’ve never heard of a fraudster who goes out of their way to reimburse the victim. 😂

I would do better and walk into the bank and give them all the details, including approx what I had spent and where. Write a list. Hand the card in along with your phone number so that you can repay the fellow.
I'm surprised this doesn't happen more often at restaurants that insist in taking and holding people's cards.

Also I would leave the 300 cash with the card at the bank too.

I have only read OPs posts but did someone really say ring the police, I noticed OP mentioned police, what a waste of time. I'm sure OP will ring the bank in the morning and sort it out.

If your husband knew all day that he had your card ( clearly your only way of paying as he was saying you couldn't pay in the supermarket) , why did he not ring you during the day?
It makes zero sense that he wouldn't have rung and said" Oi! Chinchin, you've left your card at home".
Then you would have said " No I havent it's right here".
Ergo- you realizing that you have the wrong card.
This is obviously someone having a lark, but get your details right next time. Otherwise it's a bit boring.

You can nit be armed to refund and adit to your misusing someone's card.
Supposedly a weather person's card that hangs out on mumsnet than calling into fix your error.
I would be furious and if they have online banking to track transactions I'd really be annoyed.

Well, we live very ruraly, and belive it or not, our electricity was cut off today for works. We can do VOIP but only if we have power. So, my husband had no way of contacting me all day.

I also have credit cards that I could have paid by. So I assume he thought I was using a CC.

I generally use my bank card though which is probably why he asked me when he picked me up which card I was using because I think he realised that he had my card and asked 'what card have you been using?' for me to say ;

'My CC you dick, you've got my bank card' Lolz.

But I said;

'My bank card'.

And then we realised we had two, and one wasn't mine!

Unless she's shopped locally and very well known or known to the cops, how the fuck would her name and address be known from CCTV? If that was the case we would know all criminals and wouldn't have posts on social media etc..do you know this person.
